HomeMy WebLinkAboutRES 429 Draft 01 1972-1976 County of Hawaii—State of Hawaii Resolution No. 429 RESOLUTION APPROVING APPLICATION OF SIM WENNER FOR THE ESTABLISHMENT OF A CEMETERY AT MOEAUOA, NORTH KONA, HAWAII . WHEREAS, in accordance with the provisions of Chapter 4 , Art- icle 1, of the County Code of the County of Hawaii, the applicant Sim Wenner has applied for approval for the establishment of a ceme- tery at Moeauoa, North Kona, Hawaii; and WHEREAS, the applicant has complied with all of the provisions of the County Code; and WHEREAS, the County Council has reviewed and considered the recom- mendations and action of the County Planning Commision and the State Land Use Commission; and WHEREAS , the County Council finds that the proposed use will not be contrary to the objectives sought by the State Land Use Law; and WHEREAS, the County Council further finds that the proposed use implements the General Plan Public Facilities element for Kona wherein the course of action states that "new cemetery sites to serve future needs shall be sought" ; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it hereby approves the application of Sim Wenner to estab- lish a cemetery at Moeauoa, North Kona, County and State of Hawaii, on a 10-acre area of a 24-acre parcel, and located about three miles from the Holualoa Urban District and approximately two miles south of the Palani Junction and approximately 1 ,500 feet mauka of the Mamalahoa Highway, North Kona, more particularly described on the attached map which is incorporated herein and made a part of this resolution by reference. The approval is subject, however, to the Special Permit conditions set forth by the State Land Use Commission and the County Planning Commission, and as listed herein: 1 . That the applicant, Sim Wenner, comply with all the rules and regulations as outlined in Chapter 4 , Article 1 (relating to cemeteries) of the Hawaii County Code within one year from the offi- cial date of approval. Should compliance with that regulation not be met, the special permit shall be deemed null and void. 2. That a landscaping plan prior to the clearing of the land be submitted and subsequently approved by the Planning Director. 3 . That in keeping with the General Plan's public facilities , health and sanitation element standard of encouraging the use of plaques installed flush with the ground, all grave markers shall be designed to meet this standard; 4 . That an appropriately licensed superintendent be retained to maintain the grounds and make arrangements for interments , con- forming to existing codes and regulations; 5 . That a maximum of 200 interments per acre be permitted so as to allow for the flexibility in designing the landscaping plan; • 6 . That smaller plot sizes also be made available to the public; 7 . That the 30-foot easement be improved to a twenty (20) foot pavement with two-foot shoulders and the roadway encircling the ceme- tery be a six (6) foot pavement with two (2) foot shoulders , and a six (6) foot graveled section be provided for parallel parking on the Keauhou side of the cemetery; 8 . That the proposed area of ten acres for the cemetery be delineated by a metes and bounds description which is to be submitted to the Planning Department. The Planning Department will thus reserve the right to inspect the subject area to ensure that the cemetery use does not exceed beyond the subject ten (10) acre site; 9 . That a ten (10) foot buffer strip be provided along the interior side of the proposed six-foot paved roadway encircling the proposed cemetery. No cemetery plots shall be located within this buffer area. Thus, in addition to the two-foot shoulders and the six-foot paved roadway, this stipulation would provide a clear area of approximately twenty (20) feet between the actual cemeteru use and neighboring properties to the north and south; and 10 . That all other applicable rules and regulations be complied with. BE IT FURTHER RESOLVED that the County Planning Department is hereby instructed to investigate and, upon request, report to the County Council whether the conditions have been or are being fulfilled. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii be and is hereby directed to transmit true copies of this resolution to Sim Wenner, the County Planning Department, the County Planning Commission, the State Land Use Commission, the Department of Public Works , the Department of Water Supply, and the State Department of Health.
