Resolution
WHEREAS , Section 2 of Ordinance No. 69 provides that the
County Council may, by Resolution approve by a majority of its
members , dispose of real property; and
WHEREAS , Act 265 transferred all real property to the State,
Department of Education, for the purpose of operating and maintaining
the school , without cost to the State or reimbursement to the County;
WHEREAS , within 10 years after the effective date (January 1,
1970) any property abandoned or ceases to be used for the purpose
stated in the preceding paragraph, shall be returned to the County;
WHEREAS , the two buildings located at Kailua-Kona School are
surplus and must be removed prior to phasing out of the school at
Kailua-Kona;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII:
1. That in accordance with the provisions of Ordinance No. 69 ,
the Director of Finance be authorized to dispose of the two buildings
located at Kailua-Kona School, Kailua-Kona, Hawaii , TMK: 7-5-08-13 ,
by public auction;
2. That the Director of Finance to determine the date, place,
and reasonable terms and conditions of the auction; and
3. That if no acceptable bids are received, that the buildings
be demolished and removed expeditiously.
