This is to acknowledge receipt on March 15, 2019, of the Non-Significant Zoning Change
Application and real property tax clearance. The affidavit of sign posting was received on
April 8, 2019, and the affidavit of mailing notification on March 18, 2019.
The project area is located within the Special Management Area (SMA). The Planning
Director has determined that the proposed action does not meet the definition of
"development" under Planning Commission Rule 9-4(1) but is an exempt action under
Planning Commission Rule 9-4(e)(2)(L), which states "The amendment of the General Plan,
State Land Use Boundary amendments and changes of zone."
A previous non-significant zone change request (NZC-13-000019) dated May 23, 2013,
approved the rezoning of 36,819 sq. ft. from OPEN to V-7. The current request consists of
three (3) separate portions with a combined area of 6,733 sq. ft., the proposed change being
OPEN to V-7. The subject parcel consists of 81.395 acres. The combined changes to the

With a parcel size of 81.395 acres and the requested total zoning change area of 43,552 sq.
ft. or 0.99 acre, the change is approximately 1.2% of the parcel.
According to Section 25-2-45 of the Zoning Code regarding Non-Significant Zoning Changes,
the Planning Director may administratively grant non-significant zoning changes. It must
comply with the designations for the property set forth in the General Plan and any
development plan adopted by ordinance, and must not result in an increase or decrease in
any zoning designation affecting more than five percent of the area, or one acre, of any lot,
whichever is less.
Upon review of the request, we have determined that it complies with the criteria set forth
in Section 25-2-45(2) of Chapter 25, Hawaii County Code, for determining non-significant
zoning changes:
1. The area under review is in compliance with the General Plan. The County of Hawaii
General Plan (2005) became effective on February 9, 2005. The subject parcel is
designated as "Resort Node," "Open," and "Conservation" on the Land Use Pattern
Allocation Guide (LUPAG) Map.
2. The Kona Community Development Plan (CDP) was adopted by ordinance No. 08-
131 with an effective date of September 25, 2008. The comprehensive post-tsunami
rebuild of the Project to create an enhanced resort complex to meet changing market
demands and guest expectations is consistent with the guiding principles of the Kona
CDP. The Economic Development section of the Kona CDP recognizes that tourism
(and visitor-related activities) is a major industry on the Island of Hawaii that
supports and maintains a vibrant economy in Kona which is essential for achieving
the vision of the Kona CDP.
3. The adjustment of the zoning boundary will result in a small increase in the Resort-
Hotel zoning district; however, the adjustment does not result in an increase, or
decrease in any zoning designation affecting more than five (5) percent of the area,
or one (1) acre, of any lot.

Dear Mr. Yee:
in follow-up to our discussion on January 10th we are submitting a Non-significant Zone
Change Request('NSZC) to effect an adjustment between zoning districts in order to resolve a
minor but important issue associated with the master plan for the property.
Certain planned "plunge pools" and associated deck improvements for individual hale units
within Phase II of the development are technically not allowed within the Open zoning district.
We looked at moving the involved hale structures more makai to allow for inclusion of the
.:
pools/decks within the V-7 zoning (where these improvements would be allowed) but the area
is spatially too tight and results in privacy issues; hence, we wish to place these structures
slightly mauka. Accomplishing this requires securing a NSZC to provide for a small additional.
'..7' V-7 zoning that would permit the planned improvements.Adjustments of no greater than one
acre are allowed via the NSZC rules and is a Planning Director action. Although Kona Village
has already been granted one NSZC in the past the total area involved in both the past request
as well as this request would still result in an aggregated area of less than one acre.

Nonsignificant Zone Change Application
Kona Village Resort
Location and Description of the Property: The irregular shaped Property, being Lot 2, a portion
of Royal Patent 7843, Land Commission Award 7715, Apana 10 to Lota Kamehameha,
consisting of approximately±81.395 acres, is located makai of the Queen Ka'ahumanu
Highway, and forms the heart of the Kona Village Resort("KVR") development(Exhibit A-Tax
Map). The property is bounded by the Pacific Ocean to the north, the Four Seasons Resort-
Hualalai at Historic Kaupuiehu to the west, and the KD Acquisition project lands to the east and
to the south. KVR is currently implementing its comprehensive post-tsunami rebuilding efforts.
The Property is classified Urban and Conservation by the State Land Use Commission, zoned
Resort-Hotel(V-7) and Open (0) under the Hawaii County Zoning Code, designated
primarily Resort Node, with Conservation and Open along the shoreline and anchialine
pond areas on the County's General Plan LUPAG map, and is located entirely within the
SMA. On May 17, 2013, the Planning Director determined that the General Plan Land Use
Allocation Guide ("LUPAG")for the Project Area is Resort Node. Plan Approval for the
reconstruction of Phase 1 of the project consisting of 125 Hale Units and amenities was

obtained on November 21, 2017. A time extension for Conditions 5 and 6 of Special Use
Permit 260 which permits the construction of 25 additional Hale Units (Phase II)was
granted on November 9, 2018.

Open (0). This zoning configuration was originally established under the 1976 Zoning
Ordinance
No. 76-242. Previously KVR obtained a nonsignificant adjustment of the
zoning boundaries to rezone the northeastern most corner of the Property consisting of
36,819 sq. ft. from the Open (0) zoned district to the Resort-Hotel (V-7) zoned district
(see Exhibit B). The subject of this request involves a minor adjustment to rezone
'three additional areas (Zones 2-4) totaling 8.733sq. ft. from the Open (0) zoned
district to the Resort-Hotel (V-7) zoned district to allow for the development of the
Phase II Hale Units located in proximity to an adjacent irrigation pond. The Phase
Hale Unit locations are a vital part of KVR's comprehensive post-tsunami rebuild which
seeks to create an enhanced resort complex to meet changing market demands and guest
expectations. Exhibit B includes the Non-Significant Zoning Adjustment Affecting Lot 2
map and metes/bounds descriptions for Zones 2-4.

Resort is approximately ±81.395 acres. The Prject Area rezoned under the previous
nonsignificant zone change request consists of 36,819 sq. ft. The three additional

consist of 6,733 sq. ft. The total area rezoned via nonsignificant zone change
applications after approval of this request would be 43,552 sq. ft. This is 1.2% of the
Property and involves an area less than one acre (or 43,560sq. ft.) and thus falls
within the limits of the Nonsignificant Zoning Change criteria pursuant to Section 25-2-
