Schutte, Chairman and Members of the County Council County of Hawaii 25 Aupuni Street Hilo, Hawaii M96720 Dear Chairman Schutte and Members: Change of Zone Application (REZ 93-4) Applicant: Hilo Audio, Inc. Request: CO-20 to CG-10 Tax Map Key: 2-2-21:7 and 46 The Planning Commission, after a duly held public hearing on July 15, 1993 voted to recommend for your approval the proposed legislative bill to change the district classification for approximately 20, 812 square feet from an Office Commercial-20, 000 square foot (CO-20) to a General Commercial-20,000 square foot (CG-20) zoned district. The property is located along the north side of Lanihuli Street, approximately 155 feet east of the Lanihuli Street-Kinoole Street intersection, Waiakea, South Hilo, Hawaii. The applicants propose the construction of a commercial building to accommodate their audio retail operation. The Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the change of zone: The Land Use Pattern Allocation Guide (LUPAG) map component of the General Plan is a representation of the document's goals, policies, standards, and course of action. It is also a graphic depiction of the physical relationships among the various land uses. The LUPAG map establishes the basic land use pattern for areas within the County. The requested zone change conforms to the General Plan's Land Use Pattern Allocation Guide (LUPAG) map which designates the property for High Density Urban uses. Such a designation may allow uses such as commercial, multiple family residential and related services (general and office commercial; multiple family residential up to 87 units per COMM. In order to consider an area for any type of zoning designation, the applicable goals, policies and standards of the General Plan must be adequately addressed. It is only through such a comprehensive policy analysis approach that evaluations and decisions can be made to better time or stage developments to achieve quality growth. The implications of these evaluations and decisions must also be considered as they may have an impact on other similar areas in the County. The proposed change of zone to a General Commercial zoned district will conform to the following goals, policies and standards of the Land Use Element of the General Plan: * Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural, and physical environments of the County. * Zone urban- and rural-types of uses in areas with ease of access to community services and employment centers and with adequate public utilities and facilities. * Zoning request shall be reviewed with respect to General Plan designation, district goals, regional plans, State Land Use District, compatibility with adjacent zoned uses, availability of public services and utilities, access, and public need. * The county shall encourage the maintenance of communities meeting the needs of its residents in balance with the physical and social environment. Approval of this request would also complement the following goals and policies of the Commercial Element: * "To provide for commercial developments that maximize convenience to users. * "Provide commercial developments that complement the overall pattern of transportation and land usage within the island's regions, communities, and neighborhoods. * "Commercial facilities shall be developed in areas adequately served by necessary services, such as water, utilities, sewers, and transportation systems. 0 4 1 te Honorable Spencer K. Schutte, Chairman and Members of the County Council Page 3 * "Distribution of commercial areas shall be such as to best meet the demands of neighborhood, community, and regional needs. " * The development of commercial facilities should be designed to fit into the locale with minimal intrusion while providing the desired services. Appropriate infrastructure and design concerns shall be incorporated into the review of such developments. A Course of Action for commercial development within the South Hilo District recommends that "Appropriately located commercial zoned lands shall be allocated as the need arises. " The project site is located within an area defined by the General Plan as the expansion of the Downtown Hilo Commercial Core. Expansion of commercial services within this core area would facilitate convenience to users due to its ease of access to other community, services and employment centers and the availability of adequate public utilities and facilities. The request would be consistent with the urban form depicted for Hilo in that it. would add commercial uses serving the entire City of Hilo and its surrounding region in a central location and in close proximity to other similar commercial activities. The General Plan recognized the "increase in sales in almost every category of commercial activities, [which] executed the growth in the number of establishments . . . . " and the commercial core of Hilo as "The island's major commercial center " Recent rezonings of surrounding properties to a Commercial-zoned district is testimony to the demand for commercial-zoned areas within the City of Hilo. The Hilo Community Development Plan (CDP) , adopted by Resolution in 1975, is intended to provide short and middle range implementation strategies for the goals, policies and land use pattern presented in the General Plan. While the Hilo CDP and its Zone Guide Map, adopted over 15 years ago, suggests a Multiple Residential-4, 000 square feet per unit (RM-4) designation for the project site, it recognizes the need for future commercial development to reinforce existing commercial areas by encouraging it to fill in to be a unified City Center rather than further disassemble to other parts of Hilo. This City Center is defined as the area of High Density Urban Development as outlined by the General Plan, which extends southward from the Wailuku River to the general vicinity of the University of Hawaii at Hilo. Schutte, Chairman and Members of the County Council Page 4 expansion of the High Density Urban designation during the 1989 General Plan update to include areas in the immediate vicinity of the University of Hawaii and recent Commercial rezonings within the immediate area has solidified the project area as part of the primary commercial core for this portion of Hilo. There are no endangered or threatened candidate species of flora or fauna found within the project site, nor has the project site been identified as a significant botanical or biological habitat. Due to the improved nature of the project site, it is not anticipated that the proposed use will have any adverse impact on cultural or historical resources. The project site is located within an area adequately served with essential services and facilities such as water, transportation systems, and other utilities. Water is available to the project site at a maximum of 1, 200 gallons per day. - Access to the property is from Lanihuli Street, which has a pavement width of 20 feet within a 60-foot right-of-way. As required through Ordinance No. 88-15, which rezoned the project site to its current CO-20 zoning, and similar rezonings within the immediate area, it is recommended that curb, gutter, sidewalk and pavement transition improvements along the property's Lanihuli Street frontage be provided. It is recommended that wastewater be disposed of in compliance with Department of Health regulations. While surrounding lands within this portion of Hilo has seen a definitive progression towards commercial uses, residential uses still dominate lands within the immediate vicinity of the project site. The project site itself is surrounded by lands zoned Single Family Residential-10, 000 square feet (RS-10) . Therefore, it is recommended that landscaping elements be incorporated within the proposed development to mitigate any adverse noise of visual impacts which may be generated by the proposed commercial use. This mitigative measure will ensure that the proposed development fits into the locale with minimal intrusion while providing the desired services. Finally, the property has no severe topographic or geologic problems which cannot be properly rectified or which would render the land unusable for the proposed use. 4 $. f r • r II Honorable Spencer K. CHANGE OF ZONE APPLICATION 93-4 Hilo Audio, Inc. is requesting a Change of Zone for approximately 20,812 square feet of land from an Office-Commercial-20,000 square foot (CO-20) to a General Commercial-20,000 square foot (CG-20) zoned district. The properties are located along the north side of Lanihuli Street, approximately 155 feet east of the Lanihuli Street-Kinoole Street intersection, Waiakea, South Hilo, TMK: 2-2-21: 7 and 46. GENERAL INFORMATION 1. January 28, 1980 - Planning Director approves Subdivision No. 4425, which created the subject properties consisting of 10,812 (Parcel 7) and 10,000 square feet (Parcel 46). RELEVANT BACKGROUND INFORMATION 2. October 22, 1985 - Effective date of Ordinance No. 85-83, which changed the district classification of the subject properties, hereinafter referred to as "project site", from an Single Family Residential-10,000 square foot (RS-10) to an Office Commercial-20,000 square foot (CO-20) zoned district. The former landowner and applicant, Dr. James Lutter, proposed the establishment of a dentist office within an existing single family dwelling located on ® Parcel 7. No firm development plans for Parcel 46 were provided. Approval of this ordinance was subject to, in part, the following conditions: "(B) plans for the proposed development shall be submitted to the Planning Department for plan approval review within one year from the effective date of the zone change; "(E) curbs, gutters and sidewalks shall be constructed along the frontage of the property in accordance with the standards of the Department of Public Works prior to the issuance of an occupancy permit;" 3. February 16, 1988 - Council adopts Ordinance No. 88-15, which amended Ordinance No. 85-83 by granting the former applicant an extension of time until February 16, 1989 in which to submit plans for plan approval review as required by Condition B. 4. February 8, 1989 - Plans for the proposed development submitted by applicant for plan approval review in compliance with Condition B. 5. February 14, 1989 - Preliminary Plan Approval issued to applicant for proposed development. APPLICANT'S REQUEST 6. Request: The Applicant is requesting a change of zone of the project site from a Office Commercial-20,000 square foot (CO-20) to a General Commercial-20,000 square foot (CG-20) zoned district. 7. Nature of Proposed Use: According to the application submitted, the change of zone, should it be approved, would allow the establishment of a commercial use on the project site. More specifically, the applicants propose the —2— construction of a commercial building to accommodate their audio retail operation. APPLICANT'S STATEMENT 8. See attached Exhibit B, CHANGE OF ZONE: ROY SUZUKI. STATE AND COUNTY PLANNING DOCUMENTS 9. State Land Use Designation: Urban. 10. General Plan LUPAG Map Designation: High Density Urban development. This particular area was redesignated from Medium Density Urban to High Density Urban in the 1989 General Plan update. Its High Density Urban designation may include uses such as commercial, multiple family residential and related services (general and office commercial; multiple family residential up to 87 units per acre), provided the goals, policies and standards of the General Plan are met. 11. Hilo Community Development Plan: Land Use Concept map suggests a Multiple Residential-4,000 square feet per unit (RM-4) designation. The Hilo CDP was adopted by Planning Commission Resolution in 1975. 12. County Zoning: Office Commercial-20,000 square feet (CO-20). 13. SMA: Not Applicable. -3- • DESCRIPTION OF PROJECT SITE AND SURROUNDING AREA 14. Dimensions: The project site, consisting of a total of 20,812 square feet, has a frontage along Lanihuli Street of approximately 86 feet and a depth of approximately 242 feet. 15. Physical Characteristics: An existing single family dwelling is located on Parcel 7. Parcel 46 is currently vacant. Due to the improved nature of the project site, the topography of the parcel is relatively level. 16. Soils: Soils within the project site consist of the Keaukaha Series, which are well-drained, thin organic soils overlying pahoehoe lava bedrock. The soil above the lava is rapidly permeable while the lava bedrock is slowly permeable. Runoff is medium and the erosion hazard is slight. 17. Flora and Fauna: Due to the improved nature of the project site and immediately surrounding area, it is unlikely to contain any significant historical sites or provide habitat for endangered species of plant or animal. 18. Flood Insurance Rate Map: Defines the property as being located outside of the 500-year flood plain (Zone X). 19. Adjacent Land Uses: (see attached Exhibit A) Adjacent to the north is a parcel which was rezoned to CO-20 in 1987 and on which the Hilo Law Center currently resides. Remaining parcels surrounding the project site are zoned RS-10. 20. Surrounding Land Uses: (see attached Exhibit A) Lands to the northeast (makai) between the subject property and Kilauea Avenue are zoned Double _4_ Family Residential (RD), General Commercial (CG) and Commercial Office (CO). Lands to the southwest (mauka) are primarily zoned Single Family Residential (RS). However, these RS-zoned lands are interspersed with recent Commercial rezonings. Access: Access to the project site is from Lanihuli Street, which maintains a pavement width of 20 feet within a 60-foot right-of-way. 22. Water: Water is available to the project site. 23. All other essential utilities and facilities: Are or will be made available. AGENCIES' COMMENTS 24. Department of Health: "The subject lot is located in the Critical Wastewater Disposal Area where cesspools are not allowed because of water pollution concerns. Any -5- r I development on this lot would require all wastewater [to] be disposed [of] into a Treatment Individual Wastewater System or into public sewer when available." 25. Department of Public Works: "1. Buildings shall conform to all requirements of codes and statutes pertaining to building construction. "2. All development generated runoff shall be disposed of on site and shall not be directed toward any adjacent properties. "3. Applicant shall be informed that if drywells are included in the subject subdivision improvements, Chapter 23, Underground Injection Control (UIC), Administrative Rules, Dept. of Health, prohibit any person from operating, constructing or modifying an injection well (drywell) unless authorized by a permit issued by the Director of Health, State of Hawaii. Furthermore, should dedication of roadways including drywells be contemplated, the Dept. of Public Works will not approve dedication [of) roadways prior to compliance with Chapter 23, UIC, Administrative Rules. "4. The roadway is to match curb, gutter, and sidewalk section in DPW Standard Detail R-32 for 'Business and Industrial Streets' and R-34 'Half Section of Street with Sidewalk'. Applicant should build a safe roadway transition with proper storage." 26. Fire Department: "Applicant must meet the fire flow requirements in accordance with Table 16 of the Water System Standards under Land Use. If this cannot be met, then this building proposed must be provided with an approved automatic fire sprinkler system." 27. The property is located along the north side of Lanihuli Street , approximately 155 feet east of the Lanihuli Street-Kinoole Street intersection, Waiakea, South Hilo, TMK: 2-2-21 : 7 and 46 . GENERAL INFORMATION 1 . In 1980, the property was subdivided into two lots . Parcel 7 and 46 consist of 10, 813 square feet and 20, 000 square feet, respectively. PROPOSED DEVELOPMENT 2 . Our preliminary plan is to build a commercial building for our own use. 3 . We may consolidate the two lots. 4 . We believe that the application is consistent with the goals, policies and courses of action of the General Plan document because the area of land between Kinoole and Kilauea Streets is a kind of a transition zone between the residential areas above (mauka) Kinoole and the fairly solid commercial properties along Kilauea Ave. Consistent with this, several properties on the applicant ' s street have received commercial rezoning within recent years, as well as several similar properties on adjacent streets 1 EXHIBIT B ` between Kinoole and Kilauea Ave . Across the street from the subject properties , approximately 1/2 of the block has commercial zoning. In light of these facts it would be entirely consistent and logical that our property be rezoned. Our primary reason for requesting a change of zone is that we are leasing commercial space from a landlord who is selling the property. The lease expires in 1 year and our future at this present commercial location is somewhat suspect . We purchased subject property with the intention of rezoning it for commercial use . COUNTY AND STATE PLANS 5 . The General Plan Land Use Pattern Allocation Guide (LUPAG) Map designates the property for High Density Urban Development . Such a designation may allow office and general commercial -type uses . 6 . The Hilo Community Development Plan which was adopted by the Planning Commission in 1975 suggests a Multiple Residential - 4,000 square foot (RM-4) zoning for the property. 7 . The property is not within the Special Management Area (SMA) . DESCRIPTION OF THE PROPERTY AND SURROUNDING AREA 8 . According to the Soil Survey Report published by the U.S . D.A. , Soil Conservation Service, the land is of the Keaukaha 2 Series (RKFD) which consists of well drained, thin organic soils overlying pahoehoe lava bedrock. The surface layer is about 8 inches thick. The soil above the lava is rapidly permeable . The pahoehoe lava is very slowly permeable, but water moves rapidly through the cracks. Runoff is medium, and the erosion hazard is slight . • 9 . The area receives from 90 to 150 inches of rainfall annually. 10. The property is classified Zone "C" ( .rea of minimal flooding) on the Flood Insurance Rate Map ( FIRM) . 11 . There is an existing single family dwelling on parcel 7 , while parcel 46 is vacant . 12 . In 1979, parcel 15 of TMK: 2-2-22 which is situated approximately 100 feet northwest of the property was rezoned to General Commercial-20,000 square feet (CG-20) . A doctor' s office has since been established within an existing single family dwelling on that property. 13 . The surrounding lands are used f :,r commercial purposes , including the Hilo shopping Center/Hilo Motors complex, and single family residential uses. The lands immediately abutting the property are zoned RS-10. There also are other CO zoned lands along the eastern portion of Lanihuli Street in the vicinity of Kilauea Avenue. UTILITIES AND SERVICES . 14 . Lanihuli Street has a right-of-way width of sixty feet Kilauea Streets . 15 . Water is available to the property. 16 . The property is located along the north side of Lanihuli Street , approximately 155 feet east of the Lanihuli Street-Kinoole Street intersection, Waiakea, South Hilo, TMK: 2-2-21 : 7 and 46 . GENERAL INFORMATION 1 . In 1980, the property was subdivided into two lots . Parcel 7 and 46 consist of 10, 813 square feet and 20, 000 square feet , respectively. PROPOSED DEVELOPMENT 2 . Our preliminary plan is to build a commercial building for our own use. 3 . We may consolidate the two lots . 4 .
