RESOLUTION NO.
STATE OF HAWAII
A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A
DONATION OF A WATER IRRIGATION SYSTEM AND NATIVE
HAWAIIAN PLANTS TO THE COUNTY OF HAWAII.
WHEREAS, Ka`ahahui o Ka Nahelehele ("Nahelehele") is a domestic non-profit
501 (c)(3) organization whose stated purpose is to operate exclusively for charitable, literary,
educational and scientific purposes; and
WHEREAS, the mission of Nahelehele is to facilitate and advocate for the
perpetuation of native dry forest plants, insects and birds, environmental restoration,
protection, and conservation of dry forest habitats; and
WHEREAS, in 1999, Henry Clark donated an eight -acre parcel identified as
TMK 3-6-2:007:001 to the County of Hawaii for use as a community park; and
WHEREAS, the County of Hawaii plans to develop TMK 3-6-2:007:001 into a
community park; and
WHEREAS, Nahelehele entered into a Friends of the Park agreement with the County
of Hawaii Department of Parks and Recreation on March 22, 2013 for the development of a
management plan for the proposed park within `Ouli/Lalamilo Ahupua`a near Waimea, Island
of Hawai `i; and
WHEREAS, as a donation to the County of Hawaii, Nahelehele would like to plant
native Hawaiian plants, install a water irrigation system to connect the proposed community
park to County water and pay for water service for approximately 14-18 months for native
plant restoration; and
WHEREAS, the estimated value of the donation by Nahelehele to the County of
Hawaii is $17,500; and
WHEREAS, the County of Hawaii Department of Parks and Recreation recommends
approval of this donation by Nahelehele; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the
council, on behalf of the county, may accept gifts of donations of money, securities, or other
personal property or of real estate or any interest in real estate; now therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,, in
accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the County of
Hawaii, accepts the donation of native Hawaiian plants and a water irrigation system and
service fees.
BE IT FURTHER RESOLVED that a letter of appreciation and a copy of this
resolution be sent to Nahelehele at P. O. Box 2933, Kamuela, Hawaii 96743.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to (1) Mayor Harry Kim; (2) the Department of Parks and Recreation;
(3) J Yoshimoto, Deputy Corporation Counsel, Office of the Corporation Counsel; (4) the
Department of Finance.
