Re: Bill 74 Relating to Polystyrene Foam Food Containers-
and Food Service Ware Reduction
Dear Chair Chung and Members of the Hawaii County Council:
Bill 74 was referred to me and the Environmental Management Commission("EMC")on May
21,2019,by Councilmember Tim Richards, Chair of the Committee on Agriculture,.Water,
Energy, and Environmental Management.
The proposed changes to Chapter 20,Article 6,relating to polystyrene foam food containers
were reviewed by the EMC at its monthly meeting on May 22,2019, and the EMC voted
unanimously to support the proposed changes.
I, as the director of the Department of Environmental Management,have reviewed the proposed
changes and support Bill 74 with one recommended modification. The recommendation is a
single change to the definition of"Recyclables"as detailed below in bold—specifically, it is to
replace the word"is"with"can be" so that the definition reads as follows:
"Recyclables"means material that has reached the end of its current use and [is]
can be processed into material utilized in the production of new products.
