ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 20, ARTICLE 3 (REFUSE DISPOSAL),
SECTION 20-31, OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS
AMENDED), RELATING TO THE DEFINITION OF "PUBLIC PROPERTY."
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. This amendment is proposed pursuant to a request from the Hawaii County
Department of Environmental Management to amend the definition of"public property"
contained in section 20-31 of the Code, to include real property owned by the State of Hawaii or
Federal Government as well as the County of Hawaii. The department requests this change to
authorize them to tow abandoned vehicles from State and Federal, as well as County property
pursuant to section 20-3 8.
SECTION 2. Chapter 20, article 3, section 20-31, of the Hawaii County Code 1983 (2016
Edition, as amended) is amended by amending the definition of "Public property"to read as
follows:
"Public property means all real property owned by the CountyH or State of
Hawaii, or the Federal government."
SECTION 3. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance,the brackets, bracketed and stricken material, and
underscoring need not be included.
SECTION 4. Severability. If any provision of this ordinance, or the application thereof to
any person or circumstance, is held invalid, the invalidity does not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are severable.
SECTION 5 This ordinance shall take ofa upon i! approval.
