RESOLUTION NO. 215 19
RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER
INTO AN AGREEMENT WITH THE STATE OF HAWAII SURPLUS
PROPERTY OFFICE FOR THE ACCEPTANCE OF A DONATION OF A
HYDROGEN BUS
WHEREAS, the State of Hawaii, Surplus Property Office is donating a 2012
F550 ENC Aero Elite Bus (Hydrogen Bus) to the County of Hawai`i's Mass Transit
Agency; and
WHEREAS, the bus will be used as part of the Mass Transit Agency's
transportation fleet; and
WHEREAS, the County of Hawaii will be obligated to pay a service and handling
fee of approximately $500 to the State of Hawaii, Surplus Property Office; and
WHEREAS, pursuant to Hawaii Revised Statutes, Section 46-7, this Council's
consent is required to enter into this agreement; and
WHEREAS, Article XIII, Section 13-12, of the Hawaii County Charter provides
that the Council, on behalf of the County, may accept gifts of donations of money,
securities or other personal property or of real estate or any interest in real estate, and
Chapter 2, Article 30, Section 2-162 (a) of the Hawaii County Code states that any gifts
or donations of money, securities, or personal property which fall within the
capitalization procedures of the Department of Finance, may be accepted by resolution
approved by the Council; and
WHEREAS, the County of Hawai'i's Mass Transit Agency recommends the
acceptance of this donation; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in
accordance with Article XIII, Section 13-12, of the Hawaii County Charter, and Chapter 2,
Article 30, Section 2-162(a) of the Hawaii County Code, the Council of the County of Hawaii
accepts this donation.
BE IT FURTHER RESOLVED that in accordance with section 46-7, Hawaii Revised
Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the
County, the agreement and any related documents with the State of Hawaii to receive this
donation as indicated above.
BE IT FINALLY RESOLVED that a letter of appreciation and a copy of this resolution
be sent to Mei Phillips, State of Hawaii Surplus Property Office, 729 Kakoi Street, Honolulu,
Hawaii 96819.
