Your Committee on Planning, to which was referred Bill No. 85, reports as follows:
Bill No. 85, transmitted by Mayor Harry Kim via Communication No. 337, dated June 14, 2019,
is an ordinance amending Ordinance No. 07-105 which reclassified lands from Single-Family
Residential— 10,000 square feet(RS-10)to Neighborhood Commercial—40,000 square feet(CN-40)
at Waiakea, South Hilo, Hawaii, covered by Tax Map Key 2-2-039:031, 057, 068 and 069. The
applicant, AutoZone Parts, Inc., seeks to amend several of the conditions of the original Change of
Zone Ordinance that was approved on August 1, 2007.
The Windward Planning Commission, at its duly noticed meeting on June 6, 2019, forwarded to your
Committee a favorable recommendation for thepassage of the proposed bill. Specifically, the applicant
sought to amend the following: five-year time extension for Condition C (Time to Complete h
Construction), delete Condition D (Lot Consolidation), delete Condition E (TIAR Timing), modify
Condition F (Access from Kekela Street), modify Condition H (Parking Requirements), and modify
Condition N(Fair Share).
Appearing before your Committee was attorney Steven S. C. Lim and paralegal Katherine Luga of
Carlsmith Ball, LLP representing the applicant, Michael Chastain and District Manager Jose Quintero
of AutoZone, Sohrab Rashid with Fehr and Peers Transportation Consultants, and Brian Shiroma and
family representing the landowners H. Shiroma, Incorporated.
Before any discussion, Planning Committee Vice-Chair Sue Lee Loy disclosed her involvement in
crafting the ordinance in 2007.
Mr. Lim and Ms. Luga presented a large map to Your Committee to provide a visual of the property's
location and traffic ingress and egress around the development. Mr. Chastain provided a brief history of
AutoZone in Hawaii, noting that this project would make the 12th AutoZone in the entire state and the
second in Hawaii County. He explained that the 9,000 square foot store would be larger than the two
year-old Kona location in anticipation of the higher sales expected in East Hawaii. He stated that
AutoZone differs from many of its competitors, noting that they not only sell car parts but also provide
customers with information on how to make repairs and assist with the recycling of vehicle fluids and
batteries.

An overview of the Traffic Impact Analysis Report(TIAR)was provided by Mr. Rashid, who discussed
how the traffic from the development would be managed. It was stated that the Hawaii Department of
Transportation had a draft letter in progress approving all of the proposals as laid out by Fehr and Peers'
report. Mr. Lim concluded the presentation and said that the applicant had reviewed and was in
agreement with all of the conditions as set forth in the updated ordinance.
Council Member Matt Kaneali`i-Kleinfelder asked clarifying questions around the traffic improvements
and the Department of Transportation's plans to eventually extend and widen Puainako Street to Saddle
Road as part of their identified Statewide Improvement Program, Fiscal Year 2015-2018. More detail
about ingress and egress was provided and how traffic flow for the adjacent streets would improve
because of the changes the development would bring.

The vote was then taken on the motion to move this measure to Council with a positive recommendation
and passed with nine "ayes."
Your Committee on Planning is in accord with the purpose and intent of Bill No. 85, and recommends
its passage on first reading. k
