TMK: (3) 2-6-008:028 Aloha Chair Kierkiewicz: I am providing you and the Hawaii County Council Planning Committee with an update on the resolution to the damage to the Amauluu Camp Cemetery, Pu'u`eo Ahupua`a, South Hilo, Island of Hawaii. TMK: (3)2-6-008:028. and the Notice of Violation to the Edwin C. Olson Trust II (Trust), as well as the status of the review of the Archaeological Inventory Survey(AIS)for the County of Hawaii grubbing and grading permit for this parcel. This alleged violation was originally scheduled to be heard by the Board of Land and Natural Resources (BLNR) on January 12, 2018. It was deferred when it was.learned that the notice that the alleged violation would be heard by the BLNR had been sent to the wrong party, and as a result,the Trust had not received timely notice of the BLNR meeting. Due to an internal miscommunication, for which I take full responsibility,no further action was taken regarding this matter until quite recently. The Department of Land and Natural Resources State Historic Preservation Division(SHPD)has held discussions with the Trust; and a proposed settlement has been reached. This proposed settlement is on the July 26,2019 agenda of the BLNR for decision making. The settlement addresses the alleged violation alone. The review of the AIS for the grubbing and grading permit was,on hold while resolution of the alleged violation was pending. SHPD has begun the review of the AIS because we believe that the alleged violation will be resolved pending the BLNR action Friday, July 26, 2019. Please note that the AIS addresses the grubbing and grading permit only, it doesn't address any development that may occur should the County of Hawaii approve the proposed rezoning request. The result of SHPD's review will likely,recommend specific conditions for protection of the Amauulu Camp Cemetery that are not included in the proposed settlement. SHPD reviews address only the specific action for which the permit is requested. AISs do not "clear”areas,they identify the presence(or absence) of significant historic properties and burials, and provide the information necessary to assess the effects of a proposed project on significant historic properties. The Planning Committee should be aware, as the Trust has already been made aware,that it is highly likely that a supplemental MS will be necessary was part of the planning for the development of the housing subdivision should the County approve the rezoning request,and development plans prepared and implemented. The County must also be aware that any subsequent development will need to be reviewed by SHPD to assess potential effects to significant historic properties and burial sites, and that such a subsequent review may result in additional conditions necessary to preserve such properties in accordance.with §6E HRS.
