WHEREAS, Kona Hospitality LLC, the owner (hereinafter"Applicant") of a business on the property identified as TMK No. (3) 7-5-007:009, located at street address 75-146 Sarona Road, Kailua-Kona,Hawaii, 96740 (hereinafter the "Subject Property"),has submitted to the Director of the County Department of Public Works, an Application for a variance dated April 9, 2014 (hereinafter"Application") from Section 3-58(b), "In any case, the total area allowed shall not exceed twelve square feet for any sign not fronting a public street or vehicular access or for any sign located within the Kailua Village Core"; Section 3-58(c), "Any lettering or symbol, including free-standing letters, shall not exceed nine inches in height"; Section 3-6(b)(3), "Only one ground sign shall be pennitted per lot, even if the lot is occupied by multiple businesses"; and Section 3-60(a), "Only one sign for any business or one sign for any street or vehicular access on which a building has frontage shall be permitted" as provided in the Hawaii County Code 1983 (2016 Edition, as Amended), for the Subject Property; and WHEREAS, said Application is complete and current with all information and attachments and fees paid as required under Sections 3-22 and 3-24,Hawaii County Code 1983 (2016 Edition, as Amended); and WHEREAS, said complete and current Application has received an updated recommendation from the Kailua Village Design Commission; and WHEREAS,the Subject Property includes a hotel building located at 75-146 Sarona Road, Kailua-Kona, Hawaii, 96740, and has in excess of one hundred twenty (120) linear feet of frontage along Sarona Road; and WHEREAS, the two (2)proposed wall signs will be placed on the building as follows: Sign 1 will be located above the main entrance at the second floor along the Sarong Road frontage; and Sign 2 will be located approximately three (3) feet above the third floor level along the east property frontage at the south end of the building; and WHEREAS, the two (2)proposed ground directional signs will be placed at a maximum height of forty-eight (48) inches above the ground at the two property access points along the Sarona Road; and WHEREAS, under Section 3-22(a),Hawaii County Code 1983 (2016 Edition, as Amended),the Hawaii County Council is authorized to grant, by resolution, a request for a variance from any provision of Chapter 3 if the request meets the standards of Division 6 of Chapter 3 of the County Code; and WHEREAS, pursuant to Section 3-23 of the County Code, the Council finds that the six conditions that must be satisfied to grant each of the four variances are resolved as follows: 1. Granting the variance is necessitated by peculiar physical conditions not ordinarily found in most districts, because of the peculiarity of a business, or as a result of a special event or circumstance: The international franchise brand being represented by the Applicant has established standards regarding the size and placement of signs; 2. Granting the variance will not adversely affect the rights of adjacent property owners or tenants: The adjacent tenants have approved the Applicant's request; 3. Granting the variance will not unreasonably violate the interest, safety, convenience, or general welfare of the public: The proposed sign will identify the location of the Applicant's business premises for the public and no other outside identification exists for the Applicant's business along any street frontage; 2 4. A strict application of the terms of this chapter would work unnecessary hardship and practical difficulty upon the applicant or the community: Another larger entity has obtained a variance for placement on the same wall along the same street frontage; 5. Granting the variance will not constitute a grant of personal or special privilege inconsistent with the limitations upon other properties under identical ordinances, statutes, or rules: The variance would allow the Applicant the same general privileges enjoyed by other businesses and commercial/industrial uses in the County; 6. The application is complete: A complete and current application has been transmitted to the Council prior to consideration of this resolution; and WHEREAS, Sign 1 letters shall be no more than eight(8) inches tall, and the"H" monogram logo shall be no larger than sixteen(16) inches tall with a total area no greater than twenty (20) square feet. Sign 2 letters shall be no more than six (6) inches tall, and the"H" monogram logo shall be no larger than twenty-five (25) inches tall with a total area no greater than fourteen (14) square feet and will comply with all other requirements of the County Code; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Hawaii County Code Section 3-22(a),that the Application of Kona Hospitality LLC, for a variance from Hawaii County Code Section 3-6(b)(3), Section 3-58(b), Section 3- 58(,), and 3-60(a) is hereby GRANTED, subject to the following conditions: 1. Lee, P.E., Director Department of Public Works County of Hawaii Dear Mr. Lee: SUBJECT: Kailua Village Design Commission Meeting of November 17,2015' Applicant: FHG Architects ATA, LLC Land Owner: Kona Hospitality LLC Design Review of a sign variance for two wall signs and a ground sign Tax Map Key: 7-5-007:009 (COR-15-101415) This letter is to inform you that the Kailua Village Design Commission, at its November 17, 2015 meeting,voted to recommend to the Public Works Director that the three signs proposed in the subject variance application be revised as to their size or placement as set forth below prior to your referral of this application to the County Council for its consideration of the requested variance: 1. The design of proposed wall sign facing Sarona Road(north side of the building),which is to be mounted on the portico facade above the building's main entrance, should be replaced by the alternate design presented by the applicant at this review meeting, a copy of which is attached to this'letter"as"Exhibit A." Specifically, the alternate design and any illumination of this wall sign should be within the following standards,for consistency with the objectives and guidelines for signs within the core area of Kailua Village: a. The green and white"H"logo rectangle should be relocated to be above and centered over the sign text for design symmetry with the building's architecture.The"H"logo in this location should have a maximum dimension of 16"x 16"to keep scaling appropriate to this narrow,light and slow traffic street frontage location. The text lettering should be raised, and painted with a non-reflective blue or green. b. The Commission prefers that indirect lighting(rather than interior illumination)be used to illuminate this sign,particularly due to its being situated within and oriented toward the Kailua Village core area. In either case,the Commission requests that a sign permit for this sign include a limitation on the light intensity allowed from this sign to be no more lumens than necessary for this wall sign to be visible from a distance equivalent to that from the sign to the Kuakini Highway—Henry Street intersection(approximately 700 feet). The second proposed wall sign,proposed to be at the third floor wall elevation at the mauka- south corner of the building wall facing Kuakini Highway, should maintain the maximum dimensions proposed in the variance application, and instead of simply relocating the xisting unpermitted sign from the north(Sarona)facing wall,should be re-designed to comprise raised,non-reflective letters aside the rectangular green and white"H"logo. Indirect lighting is preferred,but in any case the intensity of emitted light from this sign should be limited by an approved sign permit to only the amount of lumens necessary to be visible at a one-block distance(from the opposite side of Kuakini Highway),to respect both the existing and potential residential character of this mixed-use neighborhood. 3. The location,size,shape and materials of the proposed ground signs should be revised as follows: a. No signage should be placed on the sides of the electrical equipment enclosure,due to (1)limited visibility and distance from the principal(mauka)entrance,and (2)drawing undesirable attention to this utility feature. b. Instead,two separate ground signs of reduced size are recommended, each having a single face and to be placed at or very close to the respective mauka and makai driveway ( } entrances, orienting either toward the street(Sarona Road),or only mauka or only makai as appropriate to the principal direction of approach to each driveway. c. The two ground signs should be redesigned to comprise only the green and white"H" logo,thus serving primarily as directional signs at driveway entrances, with the size of the logo limited to the same size as that recommended for the main entrance wall sign in Recommendation no. 1 above(16"x 16"). The two ground signs may be internally illuminated,due to their positioning close to ground level,but with a limitation on allowable illumination intensity to a one-block distance. With respect to illumination of all the proposed signs,the Commission wishes to expresses its deep concern about variances allowing inappropriately bright commercial lighting within and emanating from the Kailua Village core area,particularly as it can create an undesirable effect on the preferredfuture mix of residential and business uses of this area,as envisioned in the Master Plan for Kailua-Kona. Accordingly, when a variance is to be granted from the Sign Code, the Commission requests that the special limitations on sign illumination recommended above be included as conditions of any variance approval(and the following sign permit approvals)in the Kailua Village core area. The Commission notes that the shielding requirements for Outdoor Lighting set forth in Chapter 14, Article 9 of the Hawaii County Code(preventing upward light emission),not part of this variance application,are very important,but alone are insufficient to protect the desired character of the Kailua Village Special District, Hawaii County is an Equal Opportunity Provider and EmpJover Mr.Warren H.W.
