Re: Provide Funds to Malama `O Puna
The Department of Public Works, with assistance from the Department of Research and
Development wishes to provide $28,000 to Malama `O Puna, a 501(c)3 nonprofit
organization. Funds provided by private sources will be used to establish a temporary road
for residents and farmers from Malama Ki to access lava locked homes and farms.
Enclosed is a resolution authorizing the County of Hawaii to provide $28,000 to Malama `O
Puna, pursuant to Hawaii County Code (2016 Edition as amended) Chapter 2, Article 25,
Section 2-139(a)(3)(A).
Due to the urgent need to contract services,the Department of Public Works and the
Department of Research and Development requests that a breach be authorized to submit this
resolution after the August 14, 2019 submission deadline, and to waive it from the Finance
Committee in order to be placed on the September 4, 2019 Council agenda. The Departments
also wish to request that the Council waive their five-day hold-for-reconsideration period. If

A. REQUEST:
A Resolution authorizing the County to enter into a Memorandum of Agreement with Malama `O Puna to
provide funding from Ordinance 19-22 to establish a temporary road access for residents and farmers from
Malama Ki access lava locked homes and farms.
Request to waive out of Finance Committee and 5 day hold over period plus a breach to place it on the
September 4th agenda because the residents and farmers of the Malama Ki Kipuka have been displaced for
over one-year due to the 2018 Kilauea eruption and all are anxious to return to their homes and farms.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED)•
Pursuant to Hawaii County Code ("HCC") § 2-139(a)(3)(A), the County may enter into agreement with a non-
profit organization for over$25,000 with the consent of the Council through an ordinance or resolution. .
Public Works and R&D is requesting that the Council approve a resolution authorizing R&D to enter into an
agreement with Malama '0 Puna, a 501(c)(3) organization for the purpose of funding its program, "Access to
Lava-Locked Parcels."
This application is for$28,000 from Ordinance 19-22 to be dispersed to Malama '0 Puna for the residents,
businesses, and farmers of Malama Ki Kipuka to establish a temporary road for access to their homes,
businesses, and farms. Ordinance 19-22 contains $50k of Department of Public Works funding for
emergency roads recovery and to assist with costs associated with immediate road restoration. This project
is related to the disaster recovery efforts specific to roads that were damaged by the 2018 Kilauea volcanic
eruption in the Puna district. In the interest of public health, safety, and in order to provide access to
farmers, businesses, and residents, the funding to Malama `O Puna shall be used to re-establish an access
road for the Malama Ki Kipuka residents, farmers, and businesses by providing costs for bulldozing and
administrative funding to Malama `O Puna,

RE: Resolution No. 270-19 RESOLUTION AUTHORIZING THE COUNTY OF
HAWAII TO AWARD FUNDS TO MALAMA 'O PUNA
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter,timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
