SUBJECT: BILL 111, RELATING TO SEWER CONNECTIONS
Dear Chair and Members:
I would like to once again express my strong support for Bill 111, which would, among
other things, remove the exemption from mandatory exemption currently allowed for
those whose properties aze accessible to a sewer extension which has been constructed by
a private developer.
The continuation of this exemption leaves the County in continuing jeopazdy of being
subject to sanctions by either the State Department of Health or the United States
Environmental Protection Agency. Hawaii Administrative Rules, 11-62-06(b) requires
that all buildings generating wastewater within or neaz a public sewer connect to that
sewer. By granting a purported exemption, we aze misleading out citizens by seemingly
telling them that it is permissible to violate this regulation.
Second, in the covenants which accompanied the Federal grant for the Hilo Wastewater ~'I
Treatment and Conveyance Project, Phase I, the County promises to assure the timely
hookup of residents served by the project. By disregazding that promise, the danger that
needed Federal Funds in the future will be denied to this County is a real possibility.
Third, and perhaps even more importantly, by granting special treatment to those
residents on privately built systems denied to their neighbors accessible to County built
sewers, we aze violating fundamental principle of fairness, without any sound technical or
policy reason to do so.
For these reasons, I urge your favorable action on Bill 111.
