SUBJECT: ORDINANCE AMENDING PLUMBING CODE RELATING TO WATER CONSERVATION
CHAPTER 17, ARTICLE 5
Transmitted is a proposed amendment to the Plumbinq Code relating to
water conservation.
Act 212 of the 1989 State Legislature created the State Revolving Loan
Fund for the construction of wastewater treatment works. The Act
empowers to the Director of Health to " ... make and condition loans from
the fund One of the conditions the Director of Health is requiring
is that each County pass an ordinance requiring the use of low flow water
fixtures in all new construction Projects. (Attached is DOH letter dated
July 27, 1992, to DPW to serve as a reminder of this condition and asking
for a status report.)
To comply with the loan condition, we are submitting the attached
ordinance for your approval.
We are also submitting it now so that supply houses can make plans to
handle their existing stocks of toilet fixtures which would not meet the
criteria established in the ordinance.
We will be present at the committee meeting to answer all questions.

As a reminder, the County must require low flow water fixtures in all new
construction projects, beginning December 31, 1992. This requirement is a
condition in all newly executed SRF loans and grants for the construction of
wastewater treatment facilities.
Specifically, the Hawaii Revised Statutes, Section 342D-54(4), states:
[The County must require] the installation of low flow water fixtures
and devices for faucets, hose bibs, showerheads, urinals, and toilets in
all new construction projects. These fixtures and devices shall be
approved by the International Association of Plumbing and Mechanical
Officials and shall comply with applicable American National Standards
Institute standards and such other standards as may be required by the
respective county for all new residential and public buildings,
beginning December 31, 1992.
Our Wastewater Branch defines a low flow toilet as one which uses 1.6 gallons
(6 liters) of water per flush, or less. The performance of these "ultra', low
flow toilets has been proven in laboratory and field applications.
Please submit a status of the adoption for your County's low flow water
fixture ordinance.
