Resolution No,- 241
WHEREAS, the County of Hawaii, in the interest of public safety,
has completed the channelization at the intersection of Kaakepa Street
and the Hawaii Belt Highway at Pepeekeo, District of South Hilo, County
and State of Hawaii; and
WHEREAS, the County of Hawaii must acquire certain parcels of
land, as shown in red on the maps attached hereto and marked Exhibit
A, B and C from Brewer Support Housing, Inc. which are necessary and
required for the channelization improvement project; and
WHEREAS, Brewer Support Housing, Inc. is agreeable to exchange
the above said parcels of land required for the improvement project
for the abandoned portion of Pepeekeo Street as shown in yellow on
the map attached hereto and marked Exhibit D; and
WHEREAS, it is mutually agreed between Brewer Support Housing,
Inc. and the County of Hawaii that no monetary consideration shall
be involved in the exchange; and
WHEREAS, Article 9, Section 6, Chapter 2, Hawaii County Code,
as amended, allows for the exchange of County-owned property for
private property for public purposes;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it approves and authorizes the Mayor to enter into a
land exchange with Brewer Support Housing, Inc.
BE IT FURTHER RESOLVED that the County Clerk be authorized and
directed to forward a copy of this resolution to Brewer Support Housing,
Inc. , and to the Department of Public Works and the Finance Director
of the County of Hawaii.
