Resolution No. 292
WHEREAS , pursuant to Chapter 2, Article 9 of the Hawaii
County Code, the County Council may dispose of real property
by granting an easement for particular purposes, subject to
reverter to the County upon termination or abandonment of the
specific purposes for which it was granted, provided that any
easement may be granted by direct negotiation and without
recourse to public auction when the sale price of such easement
is less than $1,000. 00; and
WHEREAS, the Kailua Kona Village Development Group is the
owner of the properties, Tax Map Key 7-5-08: 12 & 22, which
abuts on either side of the Keopu Drainage Channel, Kailua-
Kona, Hawaii; and
WHEREAS, the Kailua Kona Village Development Group
proposes to develop the above said properties into a parking
lot as a support facility to its development plan for the
former Kona Inn property; and
WHEREAS, the Kailua Kona Development Group has applied for
a grant of easement over and across Parcel 3, being a portion
of the Keopu Drainage Channel, TMK: 7-5--08 containing an area
of 3, 285 square feet, more particularly described in Exhibit A
attached hereto and made a part hereof for access purposes to
and from Tax Map Key 7--508: 12 and 22; and
WHEREAS, the granting of the easement will have no adverse
effect on the buried drainage structure (concrete) or in the
operation, repair or maintenance of drainage channel by the
County; and
WHEREAS, the County Council finds that there is an acute
shortage of parking spaces in Kailua Village and the development
of off-street parking by the private sector should be encouraged;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that it directs the Finance Director of the County of
Hawaii or his authorized representative to dispose of the ease-
ment area, Parcel 3, by direct negotiation and without recourse
to public auction in accordance with Chapter 2, Article 9 of the
Hawaii County Code.
BE IT FURTHER RESOLVED that the Finance Director sell the
easement area for the total sum of $300. 00, which said amount
includes the value of the easement based on an appraisal made
by an independent appraiser, appraisal cost and cost of publica-
tion of the public notice.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii
send copies of this resolution to the Mayor, the Director of
Finance and the Chief Engineer of the County of Hawaii.

Being a portion of L. C. Aw.
7716:5 to R. Keelikolani
Beginning et a spike in concrete on C.R. i. wall, at the
northwest corner of this parcel of land, the coordinates
of which referred to Government Survey Triangulation
Station "h'AILUA " being 2, 015.15 feet South and 744. 41 feet
East, and thence running by azimuths measured clockwise
from true South:
Along remainder of L. C. Aw. 7716:5 to R. Keelikolani on
a 808.50 foot radius curve to the right, the chord azimuth
and distance being:
1. 233 ° 41 ' 53. 2" 220. 46 feet to a spike in concrete;
2. 337° 20 ' 20 " 17. 88 feet along Parcel 5, along the
Kailua School Lot,
Executive Order No. 277,
to a spike in concrete;
3. 66 ° 41 ' 50" 86. 28 feet along Ld. Ct. App. 920;
4. 338 ° 24 ' 20" 12.10 feet along Ld. Ct. App. 920, •

Keelikolani on a 791.50 foot radius curve to the left, the
