Your Committee on Agriculture, Water, Energy, and Environmental Management,to which was
referred Bill 109, reports as follows:
Bill 109,transmitted by Council Member Herbert M. "Tim" Richards, III, via Communication No. 532
dated September 11, 2019, revises provisions relating to the 45-day period for review of amendments to
Chapters 20 (Refuse) and 21 (Sewers).
The intent of Bill 109 is to clarify the ambiguity stated in the County Code; allowing the Environmental
Management Commission(EMC)the leverage of their vote to a"neutral recommendation" if the
Council does not receive a reply from the commission, on matters relative to Chapter 20 or 21 of the
County Code within the mandated 45-day window. This will allow the Council to continue the
conversation of the legislation or communication as it awaits word from EMC. Department of
Environmental Management Director Bill Kucharski added that this will streamline the process by
amending any non reply from EMC from a negative to a neutral recommendation. Council Members
verified the specific topics required by the County Code to be reviewed by EMC.
Your Committee on Agriculture, Water, Energy, and Environmental Management is in accord with the
purpose and intent of Bill 109 and recommends its passage on first reading.
