SUBJECT: An Ordinance Amending Chapter 25, Article 5, Division 10, Section 25-5-102, of a
the Hawaii County Code 1983 (2016 Edition, As Amended), Relating to
Permitted Uses in the"CN"District.
Please find attached a bill to amend chapter 25, article 5, division 10, section 25-5-102, of the
Hawaii County Code 1983 (2016 Edition, as amended), relating to Permitted Uses in the"CN"
district.
This "housekeeping" bili restores an amendment to subsection 25-5-102(a) that was proposed in
Bill No. 94. This change to subsection (a), added "amusement and recreation facilities, indoor"
to the list of uses permitted in the CN district, and renumbered the uses that followed. A later
section in the bill, SECTION 7,proposed amendments to section 25-5-102 but inadvertently left
out the earlier changes made to subsection(a), thereby repealing them.
According to Communication No. 450, that accompanied Bill No. 94, the bill was initiated by
the Planning Director and favorably reviewed by the windward and leeward planning
commissions. Bill No. 94 subsequently became Ordinance No. 19-100.
We have requested that this matter be waived from the Committee on Planning and referred to
the full Council for immediate action,

RE: ResolutionQommunication No. 119 An Ordinance Amending Chapter
25, Article 5, Division 10, Section 25-5-102, of the Hawaii County Code 1983 (2016
Edition, as amended), relating to Permitted Uses in the "CN"District.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Planning to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Planning for placement on its future agenda.
