AN ORDINANCE AMENDING C APTE 25,ARTICLE 5,DIVISION 10,
SECTION 25-5-102, OF THE HAWAPI COUNTY CODE 1983 (2016 EDITION, A
AMENDED), LATING TO PERMITTED USES INT E "CN" DISTRICT.
E IT ORDAINED BY THE COUNCIL OF THE COUNTY OF A AI`I:
SECTION 1. Chapter 25, article 5, division 10, section 25-5-102, of the Flawai`i County
Code 1983 (2016 Edition, as amended) is amended to read as follows:
"Seco®n 25-5-102. Permitted uses.
(a) The following uses shall be permitted in the CN district:
(1) Adult day care homes.
(2)Amusement and recreation facilities, indoor.
[(24](3)Automobile service stations.
[(-3)](4) Bed and breakfast establishments, as permitted under section 25-4-7.
[(4)](51 Boarding facilities, rooming, or lodging houses,provided that the maximum
density shall be one thousand two hundred fifty square feet of land area per
rentable unit or dwelling unit.
[(-5)](66)Business services.
[(6-)](7) Cemeteries and mausoleums, as permitted under chapter 6, article 1 of this Code.
[(-7)](8) Churches, temples and synagogues.
[(S)](9) Community buildings, as permitted under section 25-4-11.
[(s3)] 10 Convenience stores.
[("]fUl Crematoriums, funeral homes, funeral services, and mortuaries.

more than just the sale of local fresh and/or raw produce, plant life, fish and
local homegrown and homemade products for more than two days a week, the
director, at the time of plan approval, shall restrict the hours of use, maintenance
and operations and may require improvements as determined appropriate to
ensure its compatibility with the existing character of the surrounding area.

(b) In addition to those uses permitted under subsection(a) above, the following uses may be
permitted in the CN district,provided that a use permit is issued for each use:
(1) Major outdoor amusement and recreation facilities.
(c) Buildings and uses normally considered directly accessory to the uses permitted in this
section shall also be permitted in the CN District."
SECTION 2. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed and stricken material, and
underscoring need not be included.
SECTION 3. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid, the invalidity does not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are severable.
SECTION 4. This ordinance shall take effect upon its approval.
