RESOLUTION NO. 422 19
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER
FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-
YEAR LEASE OF REAL PROPERTY FOR THE COUNTY OF HAWAII,
HAWAII FIRE DEPARTMENT
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other
obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one
fiscal year be approved by resolution; and
WHEREAS, Anekona Ouli Kanehoa VFD Company, a Hawaii non-profit corporation, leases
the property that contains a volunteer fire station, identified as Tax Map Key No. (3) 6-2-015:043,
situated at 62-2489 Waiula Drive, Kamuela, County and State of Hawaii; and
WHEREAS, with the consent of property owner Hale Wailani Partners LP, lessee Anekona
Ouli Kanehoa VFD Company desires to assign its lease to the County of Hawaii Fire Department, to
operate its 9 Bravo Volunteer Fire Station, for the balance of the lease period of ninety-nine (99) years,
which commenced June 5, 2014, and ends June 5, 2113; and
WHEREAS, the County of Hawaii Fire Department desires to enter into the multi-year lease
agreement to operate its 9 Bravo Volunteer Fire Station; and
WHEREAS, the County of Hawaii Fire Department is requesting authorization for the Mayor
to enter into a multi-year lease agreement with lessee Anekona Ouli VFD Company; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Honorable Harry Kim, Mayor of the County of Hawaii, is hereby authorized to enter into a multi-year
lease with Anekona Ouli VFD Company, for a term effective upon the execution of the assignment of
the lease, for the balance of the lease period of ninety-nine (99) years, which commenced June 5, 2014,
and ends June 5, 2113.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to
cover the anticipated obligations of the County under the terms of the Lease.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to:
(1) Mayor Harry Kim; (2) Department of Finance; (3) Hawaii Fire Department; (4) Keyra K. Wong,
Deputy Corporation Counsel; (5) Hale Wailani Partners LP; and (6) Anekona Ouli Kanehoa VFD
Company, PO Box 7121, Kamuela, Hawaii, 96743.
