RESOLUTION NO. 423 '19
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR MULTI-YEAR LEASES OF REAL
PROPERTY FOR THE COUNTY OF HAWAII DEPARTMENT OF ENVIRONMENTAL
MANAGEMENT
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other
obligation requiring payment of funds from the appropriations of a later fiscal year of more than one
fiscal year be approved by resolution; and
WHEREAS, the County of Hawaii Department of Environmental Management desires to
construct a new Compost Facility which will allow for the significant diversion of organic materials
away from the waste stream in accordance with a signed contract between the County of Hawaii and
Hawaiian Earth Recycling, LLC in the W. H. Shipman Industrial Park in the Puna District,
WHEREAS, the County of Hawaii Department of Environmental Management desires to
enter into a multi-year lease agreement for a 19.5 acre portion of TMK (3) 1-6-003:090 within the W.
H. Shipman Industrial Park, Puna, Hawaii, and owned by W. H. Shipman, Limited ("Landlord")
commencing on or before January 1, 2020, for a seven year term ending January 1, 2027, with two
additional five year options with the Landlord; and
WHEREAS, the County of Hawaii Department of Environmental Management is requesting
authorization for the Mayor to enter into multi-year lease agreements with Landlord for the
aforementioned property; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Honorable Harry Kim, Mayor of the County of Hawaii, is hereby authorized to enter into a multi-year
lease with W. H. Shipman, Limited for a seven year term beginning on or before January 1, 2020, with
two additional five year options.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to
cover the anticipated obligations of the County under the terms of the Leases.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to:
(1) Mayor Harry Kim; (2) Department of Finance; (3) Department of Environmental Management; (4)
Craig T. Masuda, Deputy Corporation Counsel, Section Chief; and (5) Ms. Peggy Farias, President, W.
H. Shipman, Limited, 16-523 Keaau-Pahoa Road, Keaau, Hawaii 96749.
