(2016 EDITION, AS AMENDED), RELATING TO THE FILING FEE FOR USE
PERMIT APPLICATIONS FOR HOME OCCUPATIONS IN THE "A" DISTRICT
Amends Section 25-5-62 by reducing the application fee to conduct home
occupations in agriculturally zoned districts from $500 to $100.

SECTION 1® Purpose. Many Hawaii County subdivisions are situated within areas that
are zoned agricultural. The purpose of this ordinance is to promote economic recovery, in areas
adversely affected by the recent volcanic eruption, by stimulating small business growth within
large agricultural subdivisions. This will be accomplished by reducing the filing fee from $500
to $100 to apply for a use permit, to conduct home occupations in an agriculture zone, pursuant
to section 25-4-13.
SECTION 2. Chapter 25, article 2, division 6, section 25-2-62 is amended to read as
follows:
"Section 25-2-62. Application for use permit; requirements.
(a) An application for a use permit shall be made to the commission, in accordance
with its rules, on a form prescribed by the commission.
(b) The application shall be accompanied by:
(1) A filing fee of $500; except that the filing fee shall be $100 for applications
for a home occupation in the A district, pursuant to section 25-4-13.
(2) A description of the property in sufficient detail to determine the precise
location of the property involved;
(3) A plot plan of the property, drawn to scale, with all existing and proposed
structures shown thereon;
(4) A list of names, addresses and tax map key numbers for those owners and
lessees of record of surrounding properties who are required to receive notice
under section 25-2-4; and
(5) A written description of the proposed use and a statement of objectives and
reasons for the request, including an analysis of how the request satisfies each
of the standards contained in section 25-2-65."
SECTION 3. New material is underscored. In printing this ordinance, the underscoring
need not be included.
SECTION 4. Severability. If any provision of this ordinance, or the application
thereof to any person or circumstance, is held invalid, the invalidity does not affect other
provisions or applications_ of the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this ordinance are severable.
SECTION 5. This ordinance shall take effect upon its approval.
