Pursuant to Section 92-5(a)(4), Hawaii Revised Statutes, as amended, we request an
attorney-client confidential discussion in executive session to consult with the County Council
on matters pertaining to a proposed settlement between the United States Environmental
Protection Agency and the County of Hawaii regarding the alleged operation of a large capacity
cesspool servicing the Kainaliu Parking Lot Comfort Station. We ask that this matter be placed
on the County Council's December 4,2019 agenda.
