JMtY} s h�!Y �aJiH� COUNTY OF HAWAII •_ STATE OF HAWAII Tt CF•H►.P • RESOLUTION NO. 425 19 A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A LICENSE AGREEMENT WITH SPECTRUM OCEANIC, LLC, TO ALLOW SPECTRUM OCEANIC, LLC, TO ACCESS COUNTY OF HAWAII PARKS FACILITIES LOCATED ON THE COUNTY OF HAWAII, STATE OF HAWAII, FOR THE PURPOSE OF INSTALLING WIFI EQUIPMENT. WHEREAS, the County of Hawai'i owns or maintains and operates the following park facilities located on the Island of Hawai'i: Honoka'a Gym, Papa`ikou Gym, Kea`au Community Center, Pahoa Community Aquatic Center, Pahoa Neighborhood Facility, Pahala Community Center, Waimea Community Center; and WHEREAS, Spectrum Oceanic, LLC, ("Spectrum"), as a regulated cable operator, is providing free WiFi service to the public for up to one (1) hour per day as a condition of the State of Hawai'i Department of Commerce and Consumer Affairs approval of the application made by Time Warner Cable and Charter Communications, Inc. ("Charter") to transfer Spectrum's cable television franchise to Charter; and WHEREAS, Spectrum requests a license and permission to attach, install, maintain, operate, upgrade and remove equipment, cables and devices and any successor technology thereto at the County of Hawai'i Parks facilities listed and described in Exhibit "A"; and WHEREAS, pursuant to Hawaii County Code Section 2-111 and Hawai'i County Charter Section 13-13, the Council may, by resolution, authorize the Mayor to enter into a License Agreement with Spectrum; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Hawaii County Code Section 2-111 and Hawai'i County Charter Section 13-13, the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, a License Agreement and any related documents with Spectrum allowing access to County of Hawai'i parks facilities listed in Exhibit "A".
