COUNTY OF HAWAII STATE OF HAWAII BILL NO. 227 ORDINANCE NO. 96 45 AN ORDINANCE AMENDING CHAPTER 20, ARTICLE 4, HAWAII COUNTY Y CODE, 1983, AS AMENDED, RELATING TO SOLID WASTE DISPOSAL FEES. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The Council of the County of Hawaii amends Section 20-46 by adding a subsection (d) authorizing the mayor to temporarily rescind the solid waste disposal fees with the approval of the Council. SECTION 2. Section 20-46, Disposal fees, is amended to as follows: (d) The mayor, with the approval of the Council, may temporarily rescind the solid waste disposal fees for a one week period. SECTION 3. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 4. This ordinance shall take effect upon its approval. BILL 226 (Draft 3) : Amends Chapter 2, Article 20, of the Hawaii County Code 1983 (1995 Edition) , relating to Voter Registration Data; makes voter registration data available to qualified persons or entities on computer tapes only for election or government purposes, after complying with established conditions, which includes the applicant providing computer tapes specified by the Election Division and paying the $100 charge; fees for a printed copy or extract of this data shall be in accordance with Chapter 2, Article 17, Section 2-104 . BILL 227 : An Ordinance amending Chapter 20, Article 4, Hawaii County Code, 1983, as amended, relating to Solid Waste Disposal Fees; authorizes the Mayor, with the approval of the Council, to temporarily rescind the solid waste disposal fees for a one week period. AYES: Councilmembers Arakaki, Childs, De Lima, Domingo, Osorio, Rath, Ray, Smith, and Chairwoman Bonk-Abramson - 9 . NOES: None. • 4 ! • BILL 229 (Draft 2) : An Ordinance amending Chapter 21 of the Hawaii County Code, 1983, as amended, relating to sewers; provides for all sewer extensions to be approved by resolution of the County Council, with guidelines for the applicant to follow in applying for the extension: 1) the applicant shall connect all property owners who are required to hook up to the system, if written permission is granted by the property owner; if the property owner does not give permission to the applicant to connect, then the property owner shall be required to connect to the sewer system as provided for in Chapter 21 of the Hawaii County Code; 2) if the applicant chooses for the County to construct the extension, the applicant may elect to pay the full cost for the extension and for ten years after completion of the extension receive all moneys for sewer charges collected by the County from other properties connecting to the extension, the total of such reimbursements shall not exceed the cost incurred by the application to construct the extension; plans to reimburse applicant for construction of sewer extensions shall require the approval of the County Council by resolution; or pay one half of the cost for the extension with the other half being paid by the County; if applicant chooses this method of payment the Chief Engineer or designee shall make an estimate of the cost of construction and submit it to the applicant; the applicant then deposits with the County a sum equal to one-half of such cost, then the matter shall be referred to the Council for review, approval and appropriation of the County' s share of costs; 3) - If the applicant chooses to construct the extension, shall bear the total cost of construction; the applicant may receive for ten years after completion all moneys for sewer charges collected by the County from other properties connecting to the extension; in addition, total reimbursements shall not exceed the cost incurred by the applicant to construct the extension; plans for reimbursement to the applicant for construction of the sewer system shall require the approval of the Council by resolution.
