Resolution
WHEREAS, the Davies Neighorhood Revitalization Project, which
includes the Kapehu Camp area, the Kekoa Camp and the Papaaloa Elderly
Housing site area, and the Waipunalei Camp area have been designated as
experimental and demonstration housing by Council Resolution No. 572-83;
and
WHEREAS, the Housing Administrator of the Office of Housing &
Community Development (OHCD), as the designated County of Hawaii official
to administer the project, is developing the Kapehu Camp and Papaaloa
Elderly housing areas; and
WHEREAS, Section 46-15, HRS provides for the submittal of the
preliminary plans and specifications to the County Council for approval ;
and
WHEREAS, Section 46-15, HRS also provides that the final plans and
specifications shall constitute the project standards if the final plans
and specifications do not substantially deviate from the approved
preliminary plans and specifications; and
WHEREAS, the preliminary plans and specifications for Kapehu Camp and
the Papaaloa Elderly Housing Project are attached hereto as Exhibit " A"
and "B" respectively;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that the Council approve the preliminary plans and specifications for the
Kapehu Camp and Papaaloa Elderly housing areas as part of the
experimental and demonstration housing project as provided by Section
46-15, HRS; and
BE IT FURTHER RESOLVED that the County Clerk be directed to forward
true copies of this Resolution to the Hamakua Sugar Company, the
International Longshoremen's and Warehousemen's Union, Local 142 Hawaii
Division, the Big Island Housing Foundation and the Office of Housing &
Community Development.

SUBJECT: Statutory Compli< ,ice of Resolution 933-84 to
Section 46-15, Hawaii Revised Statutes
Section 46-15 , Hawaii Revised Statutes, allows counties, through a
designated county agency or official, to submit to the county
council preliminary plans and specifications for certain housing
projects and obtain certain exemptions from existing county
statutes, ordinances and regulations. The legislative intent is to
expedite processing and reduce code requirements in the interest of
meeting the needs of affordable housing .
Act 66 of the 1984 session amended the statute to allow the
submittal of preliminary plans rather than final plans to the
council for approval. Legislators felt that final plans and
specifications were both costly and time consuming to prepare and
did not provide a significantly increased level of information to
the council on which to base a determination regarding requested
exemptions. Final plans and specifications are deemed approved by
the legislative body if they do not substantially deviate from the
approved preliminary plans and specifications, and upon such
approval serve as the standards for the particular project.
Hawaii County Council Resolution No. 933-84 which has been placed
on the Council agenda for the meeting of June 20, 1984, is in
compliance with Section 46-15, Hawaii Revised Statutes.
