,pJMtv.os p,, <br /> COUNTY OF HAWAII • �''-��' / �'� STATE OF HAWAII <br /> TE <br /> RESOLUTION NO. 458 20 <br /> A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MULTI- <br /> YEAR HOUSING ASSISTANCE PAYMENT CONTRACT (AGREEMENT) <br /> WITH AINAKEA SENIOR RESIDENCES LLP, OWNERS OF AINAKEA <br /> SENIOR RESIDENCES FOR THE SECTION 8 PROJECT-BASED <br /> VOUCHER PROGRAM (PBV PROGRAM) AS OFFERED THROUGH A <br /> PUBLIC NOTICE DATED JULY 26, AUGUST 2 AND 9, 2009 <br /> WHEREAS, Section 10-11 of the County Charter requires that any contract, lease <br /> or other obligation requiring payment of funds from the appropriations of a later fiscal year <br /> or of more than one fiscal year, be approved by resolution; and <br /> WHEREAS, the Office of Housing and Community Development (OHCD) entered <br /> into a ten-year Housing Assistance Payment Contract (Agreement) with Ainakea Senior <br /> Residences LLP, owners of Ainakea Senior Residences following public notice dated July <br /> 26, August 2 and 9, 2009; and <br /> WHEREAS, the current ten-year contract expires on February 29, 2020; and <br /> WHEREAS, the owner has submitted a written request to amend the initial master <br /> agreement to extend the initial ten-year term to the maximum allowable by the U.S. <br /> Department of Housing and Urban Development of 20-years to provide rental assistance <br /> to 29 eligible elderly participants; and <br /> WHEREAS, the purpose of the Project-Based Voucher Program is to provide for the <br /> development of viable communities in the County by providing decent housing, suitable <br /> living environments, expanding housing and economic opportunities and deconcentrating <br /> poverty; and <br /> WHEREAS, the County of Hawaii wishes to amend the current multi-year <br /> agreement with Ainakea Senior Residences LLP, owners of Ainakea Senior Residences, <br /> which was selected as a Section 8 Project-Based Voucher project by the OHCD utilizing <br /> the Section 8 Project-Based Voucher Program's evaluation process ; and <br /> WHEREAS, the OHCD is requesting authorization to extend the current multi-year <br /> agreement with Ainakea Senior Residences LLP, owners of Ainakea Senior Residences; <br /> now, therefore, <br />
