No. 655/13ill No. 127 j <br /> PLACE: Council Chambers <br /> Kailua-Dona, Hawaii <br /> TIME: 1:31 p.m. <br /> I <br /> Council Chair and Members <br /> I <br /> Hawai`i County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Finance, to which was referred Bill No. 127, reports as follows: <br /> Bill No. 127, transmitted by Finance Director Deanna Sako, via Communication No. 655 dated <br /> November 29, 2019, Amends Chapter 12 of the Hawaii County Code 1983 (2016 Edition, as <br /> amended),Relating to the Proceedings for the Formation of Improvement Districts. <br /> This bill modifies provisions to increase efficiency and program flexibility to encourage the <br /> formation of improvement districts. <br /> Finance Director Deanna Sako explained that Chapter 12 is the improvement district chapter. <br /> She indicated the chapter leaves out the rules as to how an improvement district is formed. She <br /> also stated that one item needed on Hawaii Island is improved infrastructure. Ms. Sako said <br /> generally when an improvement district is formed, a county department will take the lead on the <br /> project, and the department willget it designed and constructed. Finance Department will bill <br /> the improvement district members, and then the members would be reimbursed for the work. <br /> Ms. Sako also explained in some instances a district is formed with only one landowner whose <br /> property has not been subdivided or developed, and in these cases, Ms. Sako felt it would speed <br /> things up to give the landowner authority to do the construction with the oversight of the County <br /> to make sure it is constructed to County standards. Ms. Sako also believes it would help keep <br /> things moving, and hopefully the projects will get done faster. <br /> Council Chair Aaron Chung inquired as to who drafted the amendment, to which Ms. Sako <br /> replied Attorney Brian Hirai, from the law firm of McCorriston Miller Mukai MacKinnon, and <br /> Corporation Counsel, drafted the amendment. Chair Chung asked if Alan Okamoto was <br /> consulted since he was the original architect. Ms. Sako stated Mr. Hirai had checked things out <br /> to make sure no rules were being violated.
