RESOLUTION NO. 468 20
A RESOLUTION AUTHORIZING THE ACCEPTANCE OF ALL FUTURE
DONATIONS FROM THE DANIEL R. SAYRE MEMORIAL FOUNDATION TO THE
COUNTY OF HAWAII.
WHEREAS, the Daniel R. Sayre Memorial Foundation ("Sayre Foundation") was
established in 1997 by Dr. Frank Sayre and Laura Mallery-Sayre in memory of their son who
died in a tragic hiking accident at Pololu Valley that year and in honor of the Hawai`i County
Fire Department rescue team who worked tirelessly to recover him; and
WHEREAS, the Sayre Foundation was designed for the sole and specific purpose of
providing much needed equipment and training to the Hawai`i County Fire Department, and
since its establishment, has raised almost $5,000,000 in furtherance of that mission; and
WHEREAS, donations by the Sayre Foundation to the County of Hawai`i are made at
various times of the year and are accepted by the Hawaii County Council via resolutions,
pursuant to Article XIII, Section 13-12 of the Hawai`i County Charter(Acceptance of Gifts or
Donations), which provides that "[t]he council, on behalf of the county, may accept gifts of
donations of money, securities or other personal property or of real estate or any interest in real
estate"; and
WHEREAS, although both the administrative and legislative branches of county
government have placed a high priority on expediting the acceptance of these donations, the
process sometimes takes months to complete; and
WHEREAS, it is in the best interest of the public that a more expeditious manner of
accepting possible life-saving equipment and training from the Daniel R. Sayre Memorial
Foundation be developed; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
henceforth, all donations by the Daniel R. Sayre Memorial Foundation of equipment and/or
training support shall be deemed accepted by the Hawai`i County Council, on behalf of the
County of Hawai`i, upon receipt by the County, provided that a report of the donation is
submitted to the Council by the Finance Director within 30 days of County's receipt thereof.
BE IT FURTHER RESOLVED that this method of accepting donations from the
Daniel R. Sayre Memorial Foundation shall remain in effect until it is rescinded or otherwise
modified by the Hawai`i County Council.
BE IT FURTHER RESOLVED that no provision contained herein shall preclude the
Hawai`i County Council from approving ceremonial resolutions ratifying the acceptance of
donations from the Daniel R. Sayre Memorial Foundation.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Director of Finance, the Fire Chief, and the Daniel R. Sayre Memorial
Foundation.
