BUIIkI <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> BILL NO. 146 <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 2, OF THE HAWAII COUNTY CODE 1983 <br /> (2016 EDITION,AS AMENDED), BY ADDING A NEW ARTICLE RELATING TO THE <br /> APPROPRIATION OF DISASTER RELIEF FUNDS TO ELIGIBLE NONPROFIT <br /> ORGANIZATIONS TO PROVIDE RELIEF, RECOVERY,MITIGATION,AND <br /> REMEDIATION ASSISTANCE FOR DISASTER DAMAGE CAUSED BY THE 2018 <br /> KILAUEA ERUPTION. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Chapter 2, Hawaii County Code 1983 (2016 Edition, as amended), is <br /> amended by adding a new article to read as follows: <br /> "Article 47. Disaster Relief and Recovery. <br /> Section 2-246. Findings and purpose. <br /> The purpose of this article is to establish standards for the appropriation of disaster relief <br /> funds that the County received, or may receive, for the purposes of providing relief, recovery, <br /> mitigation, and remediation assistance for disaster damage, losses, and suffering caused by the <br /> 2018 Kilauea eruption. The Council finds that the appropriation of the disaster relief funds in <br /> accordance with this article constitutes a valid public purpose. <br /> Section 2-247. Definitions. <br /> As used in this article, unless otherwise specified: <br /> "Director"means the director of finance of the County. <br /> "Disaster relief' means monies awarded in the form of a grant to an eligible nonprofit <br /> organization for the purposes of relief, recovery, mitigation, or remediation following the 2018 <br /> Kilauea eruption. <br /> "Disaster relief funds"means funds from other public entities or private donors <br /> appropriated to the County for the purposes of relief, recovery, mitigation, or remediation <br /> following the 2018 Kilauea eruption. <br /> "Nonprofit organization"means an organization organized for other than profit-making <br /> purposes and which has a current 501(c)3 tax-exemption from the Internal Revenue Code. <br /> Section 2-248. Applicability; restrictions of funding source; County reservation of funds. <br /> (a) This article shall apply exclusively to the appropriation of disaster relief funds for the <br /> purpose of providing disaster relief to eligible nonprofit organizations. This article shall <br /> not apply to any other County funds not appropriated for disaster relief purposes. <br /> (b) If the funding source of the disaster relief funds imposes restrictions on the use of the <br /> disaster relief funds that are contrary to, or conflict with,the uses allowed under this <br />
