DAVID: And now, Director Brilhante, hana hou. And Ms. Kierkiewicz, go ahead whenever you're ready. Point of: MS. KIERKIEWICZ: Thank you, Chair. Just maybe a point of information. Information: Because in our boards we had Communication 62.5, which is a recap of hiring Andrew Levin for no more than 90 days. Monthly salary $10,000, and then we received an amended version where the salary is actually $7,500. So just looking for some clarification. And also, Director, if you might have any insight into how many cycles this contract may be reupped. I know that he was the lead advocate for our County, these last few Council terms at State Legislature. So just wondering if you can refresh our memory as to the duration of how long we retained his services. MR. BRILHANTE: Good afternoon, Committee Chair David and Committee Members. William Brilhante, Director of Human Resources. Page 4 FC-27 February 4,2020 Yeah, Ms. Kierkiewicz, you're absolutely correct. In that initial submittal from our office indicated a monthly salary of$10,000. That was an error on our part. Mr. Levin, the monthly salary is $7,500, which is consistent with what we've paid him last year. I think that$10,000 figure was from several—the previous year prior to last year, and that was the amount. And you know, we brought him on at a significantly reduced rate. i As to the second part of your question, I believe this is the third legislative cycle in which we've obtained the services of Mr. Levin. I MS. KIERKIEWICZ: Okay then,just if you are able to remember, do you know how many months his contracts were? This is for three months—this is for no more than 90 days, but I've seen things come before us where we've reupped his contract for another 90 days. I'm just wondering how long that was in previous cycles. MR. BRILHANTE: And that's correct. Because generally the Mayor's preference is to have Mr. Levin provide services to the County during the entire State Legislative cycle; I believe that's from the latter part of January through the beginning of May. And so we bring Mr. Levin on, on an 89-day contract, and then generally there's a one-day break of service and then we reupped him for the remainder of the Legislative Session,however many days that remains. And we do the calculation that way. MS. KIERKIEWICZ: Okay, great. Thank you, Mr. Brilhante. Chair, I yield. CHR. DAVID: Thank you, Ms. Kierkiewicz. Ms. Lee Loy, go ahead. MS. LEE LOY: Yeah, thank you for being here. I was more curious on the 89-day contract,the cycle, because I understand they can serve one 89-day cycle and then a second one, but after that the contract would need to change. Is there any provisions in the statute that—because he comes back every year. And so I'm wondering if there's anything in the statutes that talk about an aggregate of work over a consecutive number of years. MR. BRILHANTE: You know, actually the statute technically doesn't require that we not engage in a third rotation. It's been a County policy, an HR(Human Resources) policy, where if somebody comes on an 89-day contract, we allow for a second 89-day cycle. After that, our thought process with that is if the services were needed for a longer period of time, that should have been something considered on the initial contract and should have been addressed accordingly. So again, it's just a policy where we just allow one renewal. But there must be a break in service. And the reason that is in effect is because we're always striving to ensure that people that come on and they engage in employment with the County, we don't put them in an adverse situation. Page 5 FC-27 February 4,2020 Under the HRS (Hawai`i Revised Statutes), if an employee or an individual was to come in and they were to work longer than 90 days,then their pension or their retirement may be adversely affected. So that's the justification and the rationale for individuals to be under an 89-day contract. And that is the case here. MS. LEE LOY: And then there is no, like aggregate, right? MR. BRILHANTE: There's nothing stated specifically in the HRS. MS. LEE LOY: Okay. Okay thank you, Mr. Brilhante. CHR. DAVID: Thank you, Ms. Lee Loy. Anyone else? Any more questions? Bill 133: AMENDS ORDINANCE NO. 19-73, AS AMENDED, THE OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL YEAR ENDING JUNE 34 2020 Increases revenues in the Federal Grants—Housing Choice Voucher Program account ($48,101); and appropriates the same to the Voucher Rental Subsidies account, for a total appropriation of$18,577,430. Funds provided by the Department of Housing and Urban Development and Department of Veteran's Affairs would be used for rental assistance for eligible participants.
