Re: Resolution Authorizing the Exemption of Certain Planning and Zoning Code
Requirements
Enclosed is a proposed resolution authorizing the exemption of certain planning and zoning code
requirements for the Papa`aloa Elderly Housing project pursuant to section 46-15 of the Hawaii
Revised Statutes (HRS).
On March 16, 1983, the Hawaii County Council adopted Resolution No. 572-83 (attached
hereto for reference only; not to be included with proposed resolution)which designated the
Papa`aloa Elderly Housing site area as an experimental and demonstration housing project as
provided by HRS §46-15, which exempts the project from certain laws, code requirements and
standards. HRS §46-15 authorizes the Mayor to designate areas of land for experimental and
demonstration housing project and requires the preliminary plans and specifications of the
project be submitted to the legislative body of the County of Hawaii, the County Council, for
approval.
Lessee through OHCD is requesting Council approve the preliminary plans and specifications for
the Papa`aloa Elderly Housing project, as part of the experimental and demonstration housing
project. The list of requested exemptions is included as Exhibit B to the proposed resolution.

A. REQUEST:
The Office of Housing and Community Development (OHCD) is requesting a resolution authorizing the
exemption of certain planning and zoning code requirements for the Papa`aloa Elderly Housing project
pursuant to HRS 46-15.
- Requesting exemption to change the zoning to RD-5
- Requesting exemption to allow (1) parking space per unit
- Requesting exemption from the SMA use permit requirements
OHCD is requesting to waive Committee because of the time constraints for the project to submit their
application for Low Income Housing Tax Credits (LIHTC) which is due on April 17, 2020.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Resolution No. 572-83 designated the Papa`aloa Elderly Housing site area as an experimental and
demonstration housing project which exempts the project from certain government laws, code requirements
and standards. This resolution will promote the construction of more affordable housing units.

WHEREAS, THE County of Hawaii, through its General Plan and its County
Housing Agency goals and objectives has established as one of its housing
goats, the conservation and preservation of its present housing stock; and
WHEREAS, the Mayor of the County of Hawaii is empowered to designate areas
of land for experimental and demonstration housing projects to research and
develop ideas to reduce the cost of housing; and
WHEREAS, the County of Hawaii, Office of Housing and Community Development
has completed a preliminary feasibility analysis and has concluded that the
proposed Davies Neighborhood Revitalization Project, including the Kapehu Camp
area, the Kekoa Camp and Papaaloa Elderly Housing site area, and the
Waipunalei Camp area, is economically feasible and is appropriate to research
and develop ideas to reduce the cost of converting plantation housing from
rental to fee-simple units; and
WHEREAS, the designation of these areas of land for experimental and
demonstration housing projects is necessary for the tidy and successful
implementation of the rehabilitation program; and
WHEREAS, a public hearing on this matter has been conducted in compliance
with the requirements of the Section 4615, Hawaii Revised Statutes (HRS);
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
the Mayor is hereby authorized to designate the Kapehu Camp area, the Kekoa
Camp and Papaaloa Elderly Housing site area, and the Waipunalei Carp area (see
Exhibits A & 8) for an experimental and demonstration housing project as
provided by Section 46-15, HRS; and

BE IT FURTHER RESOLVED that the Mayor is authorized to designate the
Housing Administrator of the County of Hawaii to serve as the designated
county official to administer this Experimental and Demonstration Housing
Project as provided by Section 46-15, HRS; and
BE IT FURTHER RESOLVED that the County Clerk be directed to forward true
copies of this Resolution to the TheoDavies Hamnakua Sugar Company and the

RE: RESOLUTION NO. 548-20 : RESOLUTION AUTHORIZING THE
EXEMPTION OF CERTAIN PLANNING AND ZONING CODE REQUIREMENTS
FOR THE PAPA`ALOA ELDERLY HOUSING PROJECT PURSUANT TO
SECTION 46-15 OF THE HAWAII REVISED STATUES.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
