HomeMy WebLinkAboutRES 561 Draft 01 2018-2020 .J�tYOsp,• COUNTY OF HAWAII e• STATE OF HAWAII RESOLUTION NO. 561 20 • RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO A MULTI-YEAR MEMORANDUM OF AGREEMENT WITH THE UNIVERSITY OF HAWAII, WATER RESOURCES • RESEARCH CENTER, PURSUANT TO HRS SECTION 46-7, AND HAWAII COUNTY CHARTER SECTIONS 10-11 AND 13-13, TO PROVIDE TRAINING TO WASTEWATER TREATMENT WORKS OPERATORS. WHEREAS,the University of Hawai`i, by its Water Resources Research Center(UH- WRRC), sponsors and administers the Statewide Wastewater Operator Training Center (SWOTC); and WHEREAS,the SWOTC serves the four (4) counties of the State of Hawai`i; and WHEREAS,the SWOTC provides wastewater training classes, and upon completion of such classes, operating personnel are awarded Continuing Education Units, qualifying them to sit for exams for obtaining and/or renewing an operator certification; and WHEREAS, this is a multi-year agreement under which the SWOTC will provide twelve (12)training courses per year for a five (5) year training program; and WHEREAS, Hawaii Revised Statutes, Section 46-7 requires the County to obtain the consent of the Council;to enter into agreements with the Federal or State governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers; and WHEREAS the Hawaii County Charter, Section 10-11 requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one fiscal year shall be made or approved by resolution; and WHEREAS the Hawai'i County Charter Section 13-13 allows the county to enter into contracts with private parties, other counties, the State or the United States for the performance of any function or activity which the county is authorized to perform; and WHEREAS the Hawai'i County Charter §13-13(b) requires that such contracts: Be authorized by the council by resolution if legislative action is necessary to implement the contract; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with §46-7, Hawai`i Revised Statutes, and §§10-11 and 13-13(b) of the Hawai`i County Charter, that the Mayor of the County of Hawai`i is authorized to execute, on behalf of the County, an agreement and related documents with the UH-WRRC to enable the County to obtain the multi-year training for wastewater operators via the SWOTC as described above. BE IT FINALLY RESOLVED that the County Clerk of the County of Hawai`i shall transmit copies of this resolution to the Office of the Mayor, the Finance Department, and the Department of Environmental Management.
