RESOLUTION NO. 567 20
RESOLUTION AUTHORIZING THE ACCEPTANCE OF TECHNICAL
ASSISTANCE FOR SOFTWARE DEVELOPMENT AND IMPLEMENTATION
FROM THE FEDERAL ENVIRONMENTAL PROTECTION AGENCY TO THE
COUNTY DEPARTMENT OF ENVIRONMENTAL MANAGEMENT,
WASTEWATER DIVISION PURSUANT TO HRS SECTION 46-7, AND HAWAII
COUNTY CHARTER SECTIONS 13-12 and 13-13.
WHEREAS, the County of Hawai`i relies upon the Clean Water State Revolving
Fund Program(CWSRF) established under Section 342D Part V, Hawai`i Revised Statutes as
Amended as a source of funding for numerous projects; and
WHEREAS,the Department of Health of the State of Hawai`i requested the Federal
Environmental Protection Agency (EPA)to utilize $600,000 of CWSRF monies to fund
contract services which would include Asset Management Planning for the County of Hawaii
Department of Environmental Management(DEM), Wastewater Division; and
WHEREAS, the EPA contracted with PG Environmental to provide technical
assistance towards the development of an asset management program for the County of
Hawaii DEM; and
WHEREAS, PG Environmental, through the Federal procurement process, contracted
with NEXGEN Asset Management for the software and implementation; and
WHEREAS, funds from the EPA CWSRF will pay $137,000 for the implementation
costs and part of the first-year software licensing; and
WHEREAS, Asset Management is the managing of assets (e.g. pumps, motors, pipes,
etc.)to minimize the cost of owning and operating the assets while maintaining a desired level
of service. Benefits include prolonging the life of the asset; helping with decision-making
about asset rehabilitation, repair and replacement; continuing to meet level of service and
regulatory requirements; improved response to emergencies; and reducing capital and
operations`cost; and
WHEREAS the NEXGEN software will assist the County in accomplishing asset
management; and
WHEREAS the County of Hawai`i will assume ownership of the software licenses at
the end of the implementation period; and
WHEREAS it is planned that use of the NEXGEN Asset Management system will
continue ongoing, without the necessity of entering into a multi-year contract; and
WHEREAS, Hawai`i Revised Statutes, Section 46-7 requires the County to obtain the
consent of the Council to enter into agreements with the Federal or State governments
respecting action to be taken pursuant to any of the powers granted by law to furnish, expend,
and receive any funds or other assistance in connection with projects being or to be
undertaken pursuant to those powers; and
WHEREAS Section 13-12 of the Hawai`i County Charter authorizes the council, on
behalf of the county, to accept gifts of donations of money, securities or other personal
property or of real estate or any interest in real estate; and
WHEREAS the Hawai`i County Charter Section 13-13 allows the county to enter into
contracts with private parties, other counties, the State or the United States for the
performance of any function or activity which the county is authorized to perform; and
WHEREAS the Hawai`i County Charter §13-13(b) requires that such contracts: Be
authorized by the council by resolution if legislative action is necessary to implement the
contract; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in
accordance with § 46-7, Hawaii Revised Statutes, and, §§ 13-12 and 13-13 of the Hawai`i

County Charter, that the Council authorizes acceptance on behalf of the County of the technical
assistance for software development for the asset management system for DEM, Wastewater
Division, and the partial payment of the software licensing of the NEXGEN Asset Management
System by the EPA.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawai`i shall
transmit copies of this resolution to the Office of the Mayor, the Finance Department, and the
Department of Environmental Management.
