AN ORDINANCE AMENDING CHAPTER 23,ARTICLE 2, SECTION 23-10, OF THE
HAWAII COUNTY CODE 1983 (2016 EDITION,AS AMENDED), RELATING TO
DEFINING,ACQUIRING,AND IMPROVING ALTERNATE, CONNECTIVITY,
EVACUATION,AND MASS TRANSIT ROUTES ISLAND-WIDE.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this ordinance is to require the County to
acquire right-of-ways to be developed into alternate, connectivity, evacuation, and mass transit
routes for the purposes of decreasing traffic congestion, facilitating connectivity between
subdivisions, and providing emergency ingresses/egresses. This ordinance is in alignment with
the Puna Community Development Plan, Mass Transit Master Plan, Puna Emergency Access
Roads, Ad Hoc Committee on Puna Road Connectivity, and Federal Highway Administration
Alternate Route Handbook.
SECTION 2. Chapter 23, article 2, section 23-10, of the Hawai`i County Code 1983
(2016 Edition, as amended) is amended to read as follows:
"Section 23-10. Acceptance of highways; compliance with chapter.
(a) The council shall not take over, receive by dedication, do any repair or
construction work upon streets or pavements, water lines, street lighting systems,
sewer lines, or in any way accept as public highways any street in any subdivision
opened or platted in the County after December 21, 1966, except upon full
compliance with the provisions of this chapter.
(b) For the purposes of this section, "alternate route"means a route beginning from
one point on a primary route and terminating at another point on a primary route
that diverts primary route traffic a short distance; "connectivity route"means a
route that serves as a connector, connecting one route to a more prominent route;
"evacuation route"means the route that leads from the primary traffic area to the
place(s) used for primary or secondary evacuation; and"mass transit route"
means a route within a system of large-scale public transportation.
(c) Subsection(a)notwithstanding, when a right-of-way in any subdivision created or
platted before or after 1966 has been approved by the Council as an alternate
route, connectivity route, evacuation route, or mass transit route, the right-of-way
shall be:
(1) Acquired by and dedicated to the County;
(2) Improved by the County to the standards as defined in this chapter; and
(3) Clearly identified with proper signage as an alternate route, connectivity
route, evacuation route, mass transit route, or combination thereof.
The right-of-ways approved by the Council are as follows:

• `Ola`a Road to Highway 11. (ALT/MT)
• Ainaola Boulevard to Koloa Maoli Road. (ALT/EVAC)
• Koloa Maoli Road to Ale Road. (ALT/EVAC/MT)
• Ale Road to Moho Road. (ALT/EVAC/MT)
• Moho Road to Old Volcano Trail. (ALT/EVAC/MT)
• Old Volcano Trail to Kuauli Road. (ALT/EVAC/MT)
• Kuauli Road to Highway 11. (ALT/EVAC/MT)
ALT=alternate route, CON=connectivity route, EVAC=evacuation route, MT=mass
transit route."

SECTION 3. New material is underscored. In printing this ordinance, the underscoring
need not be included.
SECTION 4. Severability. If any provision of this ordinance, or the application
thereof to any person or circumstance, is held invalid, the invalidity does not affect other
provisions or applications of the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this ordinance are severable.
SECTION 5. This ordinance shall take effect upon its approval.
