I am writing in adamant opposition of Resolution 568-20.
Hawaii Police department may have acted, and may act, on a criminally false premise.
Proceeding without a full determination and investigation into that criminality may put
the County of Hawai'i in criminal legal jeopardy and thereby incur civil liability.
Senator Kai Kahele publicly called out DHHL Head William Aila on lying regarding DOT
jurisdiction on Mauna Kea. Mr Aila?DHHL also violated Hawaii County Ordinances
regarding the destruction of the "unpermitted structure" on Mauna Kea in a
constitutional violation of due process rights.

The fraudulent conveyance of Real Estate is also a crime under Hawai'i Revised Statutes
but I do not have the specific statute in front of me. I am happy to submit it after the
fact.
Under §710-1063 Unsworn falsification to authorities:
§710-1063 Unsworn falsification to authorities .
(1) A person commits the offense of unsworn falsification
to authorities if, with an intent to mislead a public servant in
the performance of the public servant' s duty, the person:
(c) Submits or invites reliance on any statement, document, or
record, in written, printed, or electronic form, which the person
knows to be falsely made, completed, or altered; or

Efficiency and fairness of governmental operations and public
confidence in public administration, in general, and the
administration of justice, in particular, require that information
which the government relies upon not be falsified.

False testimony and other misleading information to officials
can convert governmental power into an instrument of injustice rather
than justice, with unfortunate consequences not only for the
individual whose life, freedom or property may be affected, but also
for the community' s general sense of security and confidence in the
state.
I respectfully requestthat the County Council delay any commitment until a full public
hearing..can .be f1ad.-I--:aaso rettuest that the Council all for a criminal investigation into
the actions ofp1711-11... to tensure:,that the council does not place themselves, personally
and collectively, in--leagl-jebpardy.
