I am opposed to the Memorandum of Agreement between the State of Hawaii, and County of Hawaii as •
contained in Communication 0855.000.
The Memorandum fails to identify several very important aspects of any agreement. There are:
I. What specifically is the Hawaii County Police Department obligated to do?
2. Where is HPD obligated to perform these duties. "On or near Mauna Kea" is much too general. Will
HPD be required to take primary responsibilities in Jurisdictions primarily wider the responsibility of
DOCARE, or any other State Agency?
3. What period of time is HPD obligated to within this Agreement? "TMT Protests" as a description for
required response by HPD under this agreement does not afford the slightest identification of the duties,
or required actions of HPD. Who decides what constitutes a"TMT Protest"? What will our Officers be
responding to? Until when?
Is HPD capable of meeting the unidentified obligations ofthis agreement and still provide the Service to the
residents of our island for which each of their civil service positions were created? I don't understand how that
is possible given the lack of clarity of who,,what, where and when is required to meet this Contract. Those four
questions, who, what where and when are questions that must be answered in a complete Police report. This
agreement identifies "Who", only.
Finally, how did we get into this situation? How did our Police Department create Millions of dollars of •
accounts payable, without a legal way to recover the reimbursement? Who was instrumental in violating at the
very least the better interests of our residents, at worst a complete disregard for the laws of our County?
Fearfully, T hope those same principles who created this mess are not the primary creators and supporters of this
agreement. They obviously are unqualified to identify what is required for the TMT Protests. They completely
failed to identify the development and progression that began on July 17, 2019. Millions of dollars of
later...here we are. How can there be confidence now?

Please reject this Memorandum of Agreement. Find a way to get the monies owed to us without further
jeopardizing us.
