I am in opposition of Resolution 568-20 requesting the payment of monies owed to the
County of Hawaii by the State of Hawaii for law enforcement costs related to the
actions of our protection of Mauna Kea.
A requirement of this payment is a memorandum of agreement between the County of
Hawaii and the State of Hawaii. It is an agreement that legally should have occurred
prior to the expenses that were incurred by the Hawaii County Police Department in
the enforcement on Mauna Kea on behalf of the State of Hawaii.
There was not a memorandum of agreement prior to those expenses happening, the
County of Hawaii now has a bit of a challenge recovering those costs because that
agreement is legally required by this County.
Again, I am in opposition of Resolution 568-20, unless the resolution specifically
specifies the amount of money is owed to the County of Hawaii from the State of
Hawaii, as well as the memorandum of agreement having a termination date of
December 31, 2019.
