The language in the Memorandum of Agreement in Comm,855 and the resolution are not in aiignment The explanation of the Agenda item Undicates the inter is to reimburse the County for expenses incurred up to December 31,2019. This date does not appear on any other document • 2. The MOA does not include a total amount due which should be determined by now. 3, The MOA does not inciude a lamination date except to indicate that the agreement will continue as a lioint operation. ,& This version is more aggregious than the original attempt which was unanimously denied by the full Hawaii County Council on December 18th. S. The Finance Committee's deferral of this most important issue to the full council in effect eliminates the opportunity for the community to hear the discourse and understand the Issues related to this resolution and MOA. This is further exaceirbateo by the limited ability for public to testify only via email or mail and not In person. 6. This controversial IMI pro)ect and opposition by a signIfloantiy large population of Kanaka Maoli and public deserves full consideration.It was the single most important issue in Hawaii in 2019. The decision to try and pass this resolution and MOA during a period when the community is suffering through the effects of a warldwicie COVID-19 pandemic is really unconscionable. Further,any attempt by the$sate of Flawari and flawan County to begin construction of the IMI project on Mavnakea during,this COV1D-19 threat and under the guise of the Stay-At• More Order with accompan,,Ong increased penally for violations will be in unberievabty poor judgement The action taken by Mayor Catdwell of the City and County of Honolulu to choose this time to begin construction at HemanArtilio cannot be tolerated. Any similar attempt on Maunakea will tome the community to respond by relumine,physt.r_ally to protect the mauna from desecration.
