RESOLUTION NO. 644 20
A RESOLUTION TO AMEND PREVIOULSY GRANTED CONTINGENCY RELIEF
FUND TRANSFERS DUE TO THE EFFECTS OF THE COVID-19 PANDEMIC BY
AUTHORIZING THE EXTENSION OF THE CONTRACT PERIOD BEYOND THE
CURRENT FISCAL YEAR.
WHEREAS, due to the global COVID-19 pandemic on March 23, 2020, the Governor of
the State of Hawaii issued the Third Supplementary Proclamation issuing an Order stating "All
persons in the State of Hawaii Must Stay at Home or in Their Place of Residence"with
exceptions for essential businesses or operations; and
WHEREAS, in compliance with the "Stay At Home" Order which is still in effect many
events and activities which received Contingency Relief Funding did not occur or cannot be
completed within the contracted time period ending June 30, 2020; and
WHEREAS, due to COVID-19 many of the priority needs within this island
communities have shifted and have to be reassessed; and
WHEREAS, section 2-139(b)(2), Hawai`i County Code,provides that for grant awards
from contingency relief grants that cannot be completed the Council may direct the return of the
full appropriation or the balance of the unexpended amount; and
WHEREAS, section 2-139(b)(2), Hawai`i County Code, does not prohibit the Council
from extending the contract period beyond the current fiscal period; and
WHEREAS, for some Contingency Relief Fund grant recipients the Governor's Stay At
Home Order has prevented services from being provided within the contract term ending June
30, 2020. These services could be provided as the Council's intended if the contracted for time
of performance is extended until after Stay At Home Order is lifted; and
WHEREAS, it is anticipated that the Stay At Home Order may not be lifted until.after
June 30, 2020, which is also the end of the contingency relief fund agreements contract term; and
WHEREAS, Hawaii County Charter Section 10-11 allows for the Council to approve
the payment of funds from an appropriation of a later fiscal year or more than one fiscal year;
now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that, for
the current fiscal year, any previously granted Contingency Relief Fund Grant Agreements be
allowed to extend their contract term beyond this fiscal year ending June 30, 2020 to June 20,
2021, if funding has not been redirected prior to June 15, 2020,. grants will be extended, pursuant
to Hawai`i County Charter Section 10-11 and Hawai`i County Code Section 2-139(b)(2):
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Director of Finance.
