COUNTY OF HAWAII • STATE OF HAWAII : •:�: ,4 f of'i+�4.' - RESOLUTION NO. 646 20 A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LEASE OF REAL PROPERTY FOR THE COUNTY OF HAWAII POLICE DEPARTMENT AND THE COUNTY OF HAWAII FIRE DEPARTMENT IN KEA'AU, DISTRICT OF PUNA. WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one fiscal year be approved by resolution; and WHEREAS, the County of Hawai`i Police Department ("HPD") Kea'au Station, identified as TMK: (3) 1-6-143:010 and TMK: (3) 1-6-143:036 and the County of Hawai`i Fire Department ("HFD") Kea'au Station identified as TMK: (3) 1-6-143:037 are located contiguously from each other in Kea'au town and are owned by W.H. Shipman, Limited ("Landlord"); and WHEREAS, HPD and HFD desire to continue their occupation of their respective stations and herein request to enter into multi-year lease agreements commencing on July 15, 2020, and ending July 31, 2023, with the option to renew to be negotiated; and WHEREAS, HPD and HFD request authorization for the Mayor to enter into multi-year lease agreements with Landlord for Kea'au Police station for an annual rental amount of TWO HUNDRED FORTY DOLLARS ($240.00) per year and Kea'au Fire station for an annual rental amount of ONE HUNDRED DOLLARS ($100.00) per year; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Honorable Harry Kim, Mayor of the County of Hawaii, is hereby authorized to enter into multi-year leases with W.H. Shipman, Limited, for a term beginning July 15, 2020, and ending July 31, 2023, with the option to renew to be negotiated. BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of the Lease. BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to: (1) Mayor Harry Kim; (2) Department of Finance; (3) Police Department; (4) Fire Department; (5) Craig T. Masuda, Deputy Corporation Counsel, Section Chief; and (6) W.H. Shipman, Limited, 16-523 Kea'au- Pahoa Road, Kea'au, Hawai`i 96749.
