SUBJECT: Draft Resolution Authorizing The Acquisition Through Condemnation of Portion
Private Property Located on Tmk (3)2-3-044: 009, Ponahawai, South Hilo, Hawaii
For the Mohouli Extension From Ainako Avenue to Komohana Street.
Federal Aid Project No. STP-2790(1); DPW Project No. P-3207
Forwarded for your consideration is a draft resolution that authorizes the Office of the Corporation
Counsel to initiate proceedings in eminent domain for the taking of Parcel 7. All efforts to contact ISF
Development Co., Ltd., the last known owners of Parcel 7, have been unsuccessful. We have
successfully negotiated settlements with all other private property owners for the Mohouli Street
Extension right-of--way according to Federal Uniform Relocation Assistance and Real Property
Acquisition for Federal and Federally Assisted Programs.
Because we need to acquire theright-of--way by September 30, 1999 (end of Federal Fiscal Year 1999)
we respectfully request that this draft resolution be waived to full Council. Your favorable consideration
of this request will be sincerely appreciated.

RE: Resolution Authorizing the Acquisition Through Condemnation of Portion Private
Property Located on Tax Map Key (3) 2-3-044:009, Ponahawai, South Hilo,
Hawaii for the Mohouli Street Extension, Komohana Street to Ainako Avenue
Pursuant to Section 1(e) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Public Works and Parks to the full Council for immediate action.
In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is
granted and the matter placed onto the next Council agenda for review. However, in the event
this request is denied, for whatever reason, I understand the matter shall be referred to the
Committee on Public Works and Parks for placement on its future agenda.
