AN ORDINANCE DESIGNATING TMK(3) 6-7-002:063 AS THE "SPENCER KALANI
SCHUTTE DISTRICT PARK" PURSUANT TO CHAPTER 15, ARTICLE 8, SECTION
15-67 OF THE HAWAII COUNTY CODE 1983 (2016 EDITION,AS AMENDED);
AMENDING SECTION 15-68.1 TO ADD THE "SPENCER KALANI SCHUTTE
DISTRICT PARK" TO THE PARKS AND RECREATIONAL FACILITY SCHEDULE;
AND AMENDING CHAPTER 14,ARTICLE 1, SECTION 14-1 RELATING TO
PROHIBITING THE POSSESSION OR CONSUMPTION OF INTOXICATING
LIQUORS AT ALL TIMES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this ordinance is to name a park located in the
Waimea area of South Kohala, specifically identified as Tax Map Key(3) 6-7-002:063, and with
a physical address of 67-1315 Ala `Ohia Road, Kamuela, Hawai`i 96743.
This park which includes fields, structures, and other undeveloped sections of the
property, would be named the "Spencer Kalani Schutte District Park"pursuant to Chapter 15,
Article 8, of the Hawai`i County Code, which establishes guidelines for naming of such. Section
15-67(2)(C)(i) and (iv) provides that any open area shall be named or re-named for a person or
persons alive or deceased, who has contributed significantly to the recreational programs in the
community in which the open area is located, and the person has accomplished significant
achievements in other fields of endeavor which have been of benefit to other persons.
Spencer Kalani Schutte was born on September 24, 1935, on Oahu, and moved to
Waimea in 1962 to ranch on Hawaiian Homes land, where he resided for the remainder of his
life at his Hawaiian Homestead property on Mana Road._Prior to moving to Hawai`i Island, he
was a part of the Honolulu Police Department's motorcycle"metro squad" combating crime in
downtown Honolulu, and helped introduce the first canine unit in Hawaii. During his time in
Waimea, Schutte became a rancher and a leader in the Hawai`i Cattleman's Association helping
to lay a solid organizational foundation for Hawai`i's beef industry. In addition, he was a
fisherman and a hog farmer, operating one of the largest, most progressive piggeries in the state.
In 1980, Spencer Kalani Schutte was elected to the Hawai`i County Council and held
office for 14 years. He then became the County Deputy Director of Finance from 1997 until his
retirement in 2000. Spencer Kalani Schutte loved politics and serving the people of Hawai`i, but
ranching was his true passion.
Spencer Kalani Schutte always focused on community health and well-being, and he was
instrumental in securing funds to build the Waimea District Park, which was built in 2016 and is
now used for youth and kupuna sports, community gatherings and has been an exceptional
addition to beautiful Waimea.
Spencer Kalani Schutte was also known as a strong advocate for the elderly, the poor, the
homeless and the emotionally and physically challenged. He established the island's first
domestic violence shelter in Hilo. He always looked out for the needs of the community that he
loved. This was also evident in the groundwork he made in creating partnerships to build low
cost housing for the Council District he represented and has been credited with adding hundreds
of affordable housing units in Waimea, Waikoloa,Kawaihae,North Kohala and Hamakua.
Spencer Kalani Schutte was an outstanding leader for our island community and continued to
serve beyond his years on the Hawai`i County Council.
Spencer Kalani Schutte lost a long battle with cancer on November 28, 2000 but has not
been forgotten. On February 2, 2013, a prestigious honor was bestowed on him as one of the
founding members of an elite group called "Na Po`e I Ha'awi Aku—The People Who Gave",
which recognizes outstanding individuals in the community who sacrificed their time to provide
leadership within the community to make it a better place for present and future generations.
Additionally, on March 7, 2013,the Hawai`i State Senate honored and commemorated the late
Hawai`i County Council Member by presenting his family with a Certificate of Recognition for
his advocacy and work to help the less fortunate.
Therefore, pursuant to Chapter 15, Article 8, Section 15-67 of the Hawai`i County Code
1983 (2016 Edition, as amended), that establishes requirements for naming County parks and
recreation facilities, in recognition of Spencer Kalani Schutte's significant contributions to
community, recreational and educational programs in Waimea, the Waimea District Park is
hereby named the "Spencer Kalani Schutte District Park".

SECTION 2. Chapter 15, article 8, section 15-68.1, Hawai`i County Code 1983 (2016
Edition, as amended), relating to the Parks and Recreational Facility Schedule, is amended by
adding a new park listing to the North/South Kohala section, to be appropriately inserted and
read as follows:
"Spencer Kalani Schutte District Park"
SECTION 3. Chapter 14, article 1, section 14-1 of the Hawai`i County Code
1983 (2016 Edition, as amended), is amended to read as follows:
"Section 14-1. Intoxicating liquors prohibited in certain public places.
(a) No person shall drink, offer to drink, or display in public view in the following public areas
or buildings located thereon, any intoxicating liquors, whether in a bottle,jug, container or
otherwise:
(1) Public highways and public rights-of-way, public sidewalks, public breakwaters and
public seawalls, except seawalls in parks where drinking is not prohibited;
(2) Public parking lots, which for the purposes of this section shall mean the entire area
within any County-owned or operated off-street parking lot or facility, including but
not limited to parking and loading stalls, designated parking areas within County parks,
landscaping strips, stairwells and pedestrian passageways, internal roadways, and
roadways for ingress to and egress from such parking lot or facility;
(3) Public school grounds and buildings; •
(4) Public areas or buildings contiguous to all public school grounds and buildings, except
as provided herein;
(5) Public parks, except parks enumerated in section 14-2, on which children's playground
equipment, such as slides,jungle gyms, seesaws and swings are located;
(6) That certain portion of parcel 24 consisting of some twenty-seven thousand ninety-nine
square feet, more or less, being a portion of the property designated upon the tax maps
of the Third Taxation Division as Tax Map Key No. (3)1-5-2-24, and located in Pahoa,
District of Puna, County and State of Hawai`i;
(7) South Hilo:
(A) Ainaola Park;
(B) Clem Akina Park;
(C) Ahualani Park;
(D) All public areas, except Coconut Island, located on the Waiakea Peninsula,
makai of Kamehameha Avenue-Kalaniana`ole Avenue from the Wailoa River
estuary to the site of the former Reeds Bay Restaurant(TMK Nos. 2-1-06:11,
12, 19, and 20);
(E) Drag Strip, Hilo;
(F) Kalakaua Park;
(G) Kaumana Caves;
(H) Keikiland;
(I) Lanakila Center;
(J) Lincoln Park;

SECTION 4. New material is underscored. In printing this ordinance, the underscoring
need not be included.
SECTION 5. Severability. If any provision of this ordinance or the application thereof
to any person or circumstance, is held invalid, the invalidity does not affect other provisions or
applications of the ordinance that can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are severable.
SECTION 6. This ordinance shall take effect upon its approval.
