ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 20, ARTICLE 4, HAWAII COUNTY CODE,
1983 , AS AMENDED, RELATING TO SOLID WASTE DISPOSAL FEES .
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII :
SECTION 1 . Purpose . The Council of the County of Hawaii
finds that allowing commercial solid waste haulers to receive
partial disposal fee credit for residential waste should be a
requirement set forth in the Hawaii County Code rather than a
provision to be discretionarily included in administrative rules
of the Department of Public Works .
SECTION 2 . Section 20-46 (c) , Chapter 20, Article 4 of the
Hawaii County Code is amended as follows :
" (c) Administrative rules [may] shall provide partial credit
to commercial haulers for residential waste . "
SECTION 3 . Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material and underscoring need not be
included.
SECTION 4 . This ordinance shall take effect upon its
approval .
