SUBJECT: Improvement District No. 17
Kaloko Subdivision
Reallocation of Assessment, Lots No. 7D-B & 7D-C
Section 12-30 of the Hawaii County Code provides that if a lot in an improvement district
is subdivided, the assessment on that lot may be prorated among the lots created by the
subdivision by an amendment to the ordinance which originally established the
assessment.
Lot 7D-B in Improvement District No. 17, TMK: 7-3-051: 061 has been subdivided into
30 parcels which includes two roadways and lot 7D-C, TMK: 7-3-051: 062 has been
subdivided into 11 parcels which includes four roadways. Final approval of the revised
subdivision was granted by the Planning Department on June 8, 1999.
All requirements for reallocating the assessment have been complied with:
1. The lot owners have been notified by certified mail that they will have to pay the
county the cost of making the reallocation pending the approval of this ordinance.
2. The original purchasers of the bonds, Prudential Insurance Company of America
and Franklin Group of Funds, have been notified by certified mail and had
fourteen days to reply for a heazing.

3. Certified mail was sent to lot owner TSA International Limited and had fourteen
days to reply for a hearing.
4. The Corporation Counsel's office has reviewed and approved the proposed
ordinance for form and legality.
5. The assessment on the parcel is current.
We are requesting that this ordinance be placed on the September 9, 1999 County
Council Meeting to speed up the process of approval so that owners can be billed
separately as soon as possible.

Pursuant to Section 1(e) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
