I am reminding the County government of the Telecommunications Act of 1996, the sweeping federal legislation signed into law by President Clinton that empowers the FCC to rule the airwaves in place of local and state governments. Specifically, Section 704 of the act says, "No state or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extend that such facilities comply with the Commission's regulations concerning such emissions." To put it bluntly, if the Federal Communications Commission (FCC)finds 5G or any other cell technology safe, which it has, local governments have no standing to impact the roll-out of any carrier's plan to offer 5G wireless products and services as long as they're compliant with federal law. So please save your time and the county's budget fighting unnecessary battles that cannot be won.
