MINUTES
MAY 2, 2019
The Windward Planning Commission met in regular session at 9:00 a.m. in the County of
Hawaii, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chairman
Joseph Clarkson presiding.
COMMISSIONERS PRESENT: Gilbert Aguinaldo, Dean Au, Joseph Clarkson, Thomas
Raffipiy, John Replogle.
ABSENT & EXCUSED: Donn Dela Cruz.
ALSO PRESENT: Michael Yee (Planning Director), Malia Hall (Deputy Corporation Counsel
for the Windward Planning Commission), Jeff Darrow (Planning Program Manager), Maija
Jackson (Planner), Christian Kay (Planner), Jessica Andrews (Planner), and Sarah Hata-Finley
(Commission Secretary).
A quorum was present. Chairman Clarkson introduced Windward Planning Commissioners and
staff to members of the public and went over the procedures for public testimony.
STATEMENTS FROM THE PUBLIC — No statements were presented under this section of the
agenda.
1. APPLICANT: EDMUND C. OLSON TRUST (SLU 17-000049/REZ 17-000223)
Applications for a State Land Use Boundary Amendment from Agricultural to Urban for
14.95 acres of land and a Change of Zone from an Agricultural -20 acres (A -20a) and
Open (0) to a Single -Family Residential -10,000 square feet (RS -10) zoning district for
approximately 14.95 acres of land and a Change of Zone from an Agricultural -20 acres
(A -20a) to a Family Agricultural -1 acre (FA -la) zoning district for approximately 24.73
acres of land. The subject properties are located mauka (west) of Wainaku Street and
north of Amau`ulu Road in the vicinity of Clem Akina Park, Puueo, South Hilo, Hawaii,
TMK: (3) 2-6-008:026 & 027.

2. APPLICANT: LEONARD AND MARIANNE FREEMAN (REZ 19-000234)
Application for a Change of Zone from an Agricultural -20 acres (A -20a) to an
Agricultural -5 acres (A -5a) zoning district for approximately 11.57 acres of land. The
subject property is located on the northwest side of Kihalani Homestead Road, about 0.90

miles from its intersection with Hawaii Belt Road (Highway 19), Kihalani Homesteads,
North Hilo, Hawaii, TMK: (3) 3-5-004:030.
The Commission took this item up at 10:09 a.m. with 10 members of the public in attendance.
Chairman Clarkson called a recess at the request of staff at 10:10 a. m., and the meeting was
reconvened at 10:18 a.m.

3. APPLICANT: SUSAN KIM (SPP 18-000203)
Application for a Special Permit to establish a one -bedroom bed and breakfast operation
within an existing two-bedroom dwelling on 0.65 acres of land situated in the State Land
Use Agricultural District. The subject property is located at 15-921 Paradise Ala Kai,
approximately 0.4 miles from the intersection with Beach Road, Hawaiian Paradise Park
Subdivision, Kea`au, Hawaii, TMK: (3) 1-5-057:087.

4. APPLICANT: CELLCO PARTNERSHIP DBA VERIZON WIRELESS
(USE 19-000079)
Continued hearing on an application for a Use Permit to allow the construction of a non -
manned telecommunication facility consisting of a 155 -foot tall monopine pole and
auxiliary equipment within a 900 -square foot portion of a 3 -acre parcel of land situated in
the County's Agricultural -3 acres (A -3a) zoning district. The property is located on the
north (mauka) side of Pdhoa-Kalapana Road (Highway 130) about 1.2 miles south of
Black Sand Beach subdivision, Kikala-Keokea Homesteads, Puna, Hawaii, TMK:
(3) 1-2-007:081 por.

Chairman Clarkson called a recess at 10:41 a.m. at the request ofMs. Hall, and the meeting was

5. APPLICANT: PIILANI PARTNERS, LLC (SMA 18-000070)
Consideration and Adoption of Proposed Findings of Fact, Conclusions of Law and
Decision and Order for denial of a Special Management Area Use Permit to allow the
development of a potable water well and bottling facility with related improvements on a
2.5712 -acre parcel within the Special Management Area. The subject property is located
at 525 Pi`ilani Street, at the northeastern corner of the Pi`ilani Street-Mililani Street
intersection, Waiakea, South Hilo, Hawaii, TMK: (3) 2-2-033:011.
The Commission took this item up at 11:44 a.m. with 2 members of the public in attendance.
[Note: Commissioner An recused himself from participating in this agenda item as he was not
present at any of the prior hearings and did not review any of the material regarding this
matter.]

MINUTES — The Commission took this item up at 11:48 a.m.
Approval of Minutes of the April 4, 2019 Meeting_— It was moved by Commissioner Replogle
and seconded by Commissioner Aguinaldo, that the Minutes of April 4, 2019, be approved as
circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance.
ADMINISTRATIVE MATTERS
Discussion of recent Special Management Area (SMA) determinations, minor permits
and enforcement action issued by the Planning Director.
At 11:49 a.m., Mr. Darrow briefly went over the SMA report for April and reviewed the
enforcement actions at Chairman Clarkson's request, noting that most of the enforcement actions
were along the coastline. Mr. Darrow also commented that the Department had received
numerous SMA Assessment applications within the past month.
Commissioner Au asked Mr. Darrow for an update on the Mallick SMA Assessment Application
[SAA 18-001644] and whether this was the old Hilo Hotel. Mr. Darrow said that the property
was in Keaukaha and that the application had been recently withdrawn by the applicant for
reassessment and future resubmittal. Upon Commissioner Au's inquiry, Mr. Darrow stated that
he believed that the old Hilo Hotel property was not in the SMA.
ANNOUNCEMENTS — At 11:53 a.m., Ms. Hall informed the Commission that their previous
decision on the Cellco application was affirmed by the court [USE 17-000074].
Mr. Darrow stated that the Leeward and Windward Commissioners would be sent the minutes
[April 4th Windward; March 21st Leeward] concerning their recent discussions regarding permit
and ordinance condition deadlines and consequences of not complying with condition deadlines.

He said that staff would summarize their ideas and get additional input for future rule and code
amendments.
Upon Chairman Clarkson's inquiry, Mr. Darrow stated that the Commission's previous request
to restructure Planning Commission Rule 4 would be reviewed.
ADJOURNMENT — There being no further business, it was moved by Commissioner Replogle
and seconded by Commissioner Raffipiy that the meeting be adjourned. Motion was
unanimously carried by a voice vote of all Commissioners in attendance. Chairman Clarkson
adjourned the meeting at 11:55 a.m.
