HomeMy WebLinkAbout2019-05-02 Hearing Transcript - Susan Kim SPP 18-203WINDWARD PLANNING COMMISSION COUNTY OF HAWAII HEARING TRANSCRIPT MAY 2, 2019 A regularly advertised hearing on the application of SUSAN KIM (SPP 18-000203) was called to order at 10:31 a.m. in the County of Hawaii Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii with Chairman Joseph Clarkson presiding. COMMISSIONERS PRESENT: Gilbert Aguinaldo, Dean Au, Joseph Clarkson, Thomas Raffipiy, John Replogle. ABSENT & EXCUSED: Donn Dela Cruz. ALSO PRESENT: Michael Yee (Planning Director), Malia Hall (Deputy Corporation Counsel for the Windward Planning Commission), Jeff Darrow (Planning Program Manager), Maija Jackson (Planner), Christian Kay (Planner), Jessica Andrews (Planner), and Sarah Hata-Finley (Commission Secretary). And 6 members from the public in attendance. APPLICANT: SUSAN KIM (SPP 18-000203) Application for a Special Permit to establish a one -bedroom bed and breakfast operation within an existing two-bedroom dwelling on 0.65 acres of land situated in the State Land Use Agricultural District. The subject property is located at 15-921 Paradise Ala Kai, approximately 0.4 miles from the intersection with Beach Road, Hawaiian Paradise Park Subdivision, Kea`au, Hawaii, TMK: (3) 1-5-057:087. CLARKSON: The next item on the agenda is an application from Susan Kim for a Special Permit to establish a one -bedroom B&B. ANDREWS: Okay, hi, I'm Jessica. I'm presenting Susan Kim's application. This is Special Permit application SPP 18-203. The location map shows the subject property is in Hawaiian Paradise Park. It's outlined in red here. The Applicant is requesting a Special Permit to establish a one -bedroom bed and breakfast operation in an existing two-bedroom home. The Applicant intends to live in the existing master bedroom while hosting guests in the second bedroom. The Applicant's objective is to provide alternative accommodations for visitors to the Island of Hawaii. The zoning map here shows that the subject property outlined in red is Ag — 1 acre, and the State Land Boundary, its designated Agricultural. On the LUPAG Map, it's designated as Open. Again, the subject property outlined in red here. It's Open, and the neighboring properties mauka of the subject property is designated Rural. EXHIBIT C So, this is the Applicant's proposed site plan, and I'll just point out some of the highlighted, some of the notes here explaining the complete proposal for the property. The existing house is here in tan with the area that's proposed as a bed and breakfast in gray, and that all is part of the existing footprint of the house. There is a proposed—there is an existing septic system and a proposed structure that is currently under construction that is a new garage/storage/home office, and then there is currently a proposed pool. And, the garage/storage/home office and the pool have both been granted exemption under SMA rules as accessory, and there is, as explained in your background documents, there is an SMA Minor that's been granted for the one -bedroom bed and breakfast. And, that was a concurrent application. The aerial photograph here shows the property outlined in black, and you can see that it directly fronts the shoreline and the road is Paradise Ala Kai. This is the site photographs that show the entry gate on the left for the subject property as seen from Paradise Ala Kai, and on the right is a view directly into the subject property seen from the entry gate. You can see the construction project that is currently in process here, and then behind these trees slightly obscured is the existing two-bedroom house. This is the dwelling, existing dwelling, as seen from the shoreline looking back towards the, towards the house, and then this is looking towards the shoreline from the existing lanai. Oops, excuse me, jumped a little too far ahead there. And, the final photographs show the Paradise Ala Kai, the street, looking south on the left and looking north from the subject property on the right. The Planning Director is recommendation is approval with conditions, and if there are any questions, I'd be happy to address that. CLARKSON: Any questions for staff from the Commission? If not, will the Applicant or their representative please come forward? Please raise your right hand. Do you swear or affirm to tell the truth on this matter before the Commission today? KIM: Yes. CLARKSON: Please introduce yourself and your relationship to the application and proceed, please. KIM: I'm Susan Kim and the property owner. Is there anything else I need to say? CLARKSON: If you think that the staff presentation was pretty complete, you don't have to say anything if you don't want. Are there any questions from the Commission for the Applicant? AU: Yeah, I have a question. Are you, did you read the conditions set forth upon you? Are you okay with that? KIM: Yeah, I actually had a clarifying question about that, but I was trying to figure out where exactly it was on this page. I think I had the condition of—can you point it out to me? AU: Conditions are on page 5 and 6. There's five conditions. EXHIBIT C 2 KIM: Oh yeah, yeah. Yes. CLARKSON: You accept the conditions as presented? KIM: Yes. CLARKSON: Thank you for that question. Any further questions? AGUINALDO: Yeah, I have one. As far as the plot plan, it shows existing two-bedroom dwelling in existing 3 -bedrooms septic system. Is that, you know, on record or—because normally on a 2 -bedroom system is a different size, but I don't know if they oversized the septic system? ANDREWS: That the subject system is a 3 -bedroom? AGUINALDO: Yeah. ANDREWS: My understanding is that it typically is 3 -bedroom or 5 -bedroom septic system approvals. AGUINALDO: Okay. Okay, that's it. CLARKSON: I just did have one other question. I noticed that the existing house has a garage. KIM: Hm-hmm. CLARKSON: At least on the plot plan. But, you're building a garage. Do you have any plans for the old garage? KIM: Oh, it's going to stay a garage. It's just for extra parking if I do have a guest `cause it's if you leave your car outside if you're on the ocean CLARKSON: Oh, okay— KIM: —it's like, you get it CLARKSON: No, that explains it. KIM: Yeah. CLARKSON: Any further questions? Thank you. You may be seated. Is there anyone that wishes to testify on this application? If not, I'll request a motion for the closing of public testimony. AU: I move to close public testimony. EXHIBIT C 3 AGUINALDO: I second. CLARKSON: All those in favor? COMMISSIONERS: Aye. CLARKSON: Opposed? Public testimony is closed. AU: Mr. Chair, I'm prepared to make a motion. CLARKSON: Please proceed. AU: I move that application Special Permit Docket No. 18-000203 be approved based on the Planning Director's recommendation which shall be adopted. AGUINALDO: I second. AU: It's been moved and seconded that this application be recommended for approval. Any further discussion? If not, please poll the Commission. ANDREWS: Okay, we'll take a vote. Commissioner Au?
