HomeMy WebLinkAbout2019-05-02 Hearing Transcript - Piilani Partners SMA 18-070WINDWARD PLANNING COMMISSION COUNTY OF HAWAII HEARING TRANSCRIPT MAY 2, 2019 A regularly advertised hearing on the consideration and adoption of the Proposed Findings of Fact, Conclusions of Law, and Decision and Order for PIILANI PARTNERS, LLC (SMA 18- 000070) was called to order at 11:44 a.m. in the County of Hawaii Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii with Chairman Joseph Clarkson presiding. COMMISSIONERS PRESENT: Gilbert Aguinaldo, Joseph Clarkson, Thomas Raffipiy, John Replogle. ABSENT & EXCUSED: Donn Dela Cruz. RECUSED: Dean Au. ALSO PRESENT: Michael Yee (Planning Director), Malia Hall (Deputy Corporation Counsel for the Windward Planning Commission), Jeff Darrow (Planning Program Manager), Maija Jackson (Planner), Christian Kay (Planner), Jessica Andrews (Planner), and Sarah Hata-Finley (Commission Secretary). And 2 members from the public in attendance. APPLICANT: PIILANI PARTNERS, LLC (SMA 18-000070) Consideration and Adoption of Proposed Findings of Fact, Conclusions of Law and Decision and Order for denial of a Special Management Area Use Permit to allow the development of a potable water well and bottling facility with related improvements on a 2.5712 -acre parcel within the Special Management Area. The subject property is located at 525 Pi`ilani Street, at the northeastern corner of the Pi`ilani Street-Mililani Street intersection, Waiakea, South Hilo, Hawaii, TMK: (3) 2-2-033:011. CLARKSON: At this time, we have one more item on the agenda, some more unfinished business. This is a consideration and adoption of Proposed Findings of Fact, Conclusions of Law, and Decision and Order for our previous denial of the SMA Permit for Piilani Partners. AU: Mr. Chair, may I make a statement for the record? For application number five, Piilani Partners, I will be recusing myself, and the reason being is I wasn't present at prior hearings which was many hearings and I have not reviewed any of the documents. So, again, I will be recusing myself. CLARKSON: Thank you. And, does staff have— DARROW: We'll need to wait for Commissioner Aguinaldo to have quorum. Thank you. [Commissioner Aguinaldo briefly stepped away from the Commission table and returned.] 10V1111.11 11 CLARKSON: All right, at this time, we have a member of the public that is wishing to testify. Would Cory Harden please come forward? Please raise your right hand. Do you swear or affirm to tell the truth on this matter before the Commission? HARDEN: Yes. CLARKSON: Please introduce yourself and proceed with your testimony. HARDEN: Cory Harden, Sierra Club, Hawaii Island Group. Just came down hoping there would be no last-minute glitches and wanted to thank you folks for protecting public trust issues and for protecting the environment. So, mahalo. CLARKSON: You're welcome. At this time, the Commission has been presented, long presented with the proposed findings. Is there any amendments that anyone wishes to make or discussion? If not, the Chair will request a motion for action. RAFFIPIY: Mr. Chair, I'm prepared to make a motion. I move to adopt the Proposed Findings of Fact, Conclusions of Law, and Decision and Order. AGUINALDO: I second. CLARKSON: It's been moved and seconded that the [proposed findings] be adopted. Any further discussion? If not, call for a vote. KAY: Mr. Chair, just for clarification. Was the second Commissioner Aguinaldo? AGUINALDO: Yes. CLARKSON: Yes. KAY: Okay, thank you. AGUINALDO: That's correct. KAY: Thank you. Allright. Commissioner Raffipiy? RAFFIPIY: Aye.
