I. Call To Order
The meeting was called to order by Chair Shelby Nahale-a at 10:00 A.M., in the
Meeting Room, Department of Liquor Control, West Hawaii Civic Center,
74-5044 Ane Keohokalole Highway, Building B, 2nd Floor, Kailua-Kona, Hawaii.
The following were present and constituted a quorum:

Nahale-a: Good morning everyone. I'd like to call the meeting of the County of Hawaii
Liquor Commission to order. If everyone could please place your cell phones or any
other devices on silent we would appreciate it. A couple of housekeeping things: we are
recording this meeting so please remember to speak one at a time so that the recording
remains clear; the microphones in the room do not amplify your voice but only record
what is being said. Can we start by going around the room to introduce ourselves, Dorsi?

Nahale-a: We have an addendum to the agenda. Pursuant to Section 92-7, Hawaii
Revised Statutes, as amended, Item 1 is the proposed amendment to the agenda and
has been determined not to be of reasonably major significance nor does it affect a
significant number of persons, and are proposed for placement on the agenda by
two-thirds vote of the Commission.

discussion on removing conditions placed on its Small
Craft Producer Pub liquor license, Category B1, by the
Liquor Commission on April 5, 2018.

Simpson: We are a fish and chips restaurant in downtown Hilo on Waianuenue Avenue.

Takase: Madam Chairman, the applicant mailed 6 out of 7 notices within 100 feet, and
42 out of 46 within 500 feet. There were 42 properties entitled to protest and we had no
protests to this application.

kitchen so we could offer more hot foods to our customers in addition to our sushi.

Greenwell: Director, do you have anything to add to this?
Takase: We met with Nathan and Jason and the previous manager and they talked
about trying something new. They've been a private club for a while but they were
having a lot of business from their guests. As a club, their members would have to pay
for their guests all of the time, so it was becoming burdensome for the club members.
They decided to convert to a Restaurant license so that guests of the members can pay
directly. It's something a little different for their club, but frankly, we might see other
clubs start to convert this way as well.
Greenwell: Do you have any comments on the TMK number changes?
Takase: No. It's all within their resort area. It was just a matter of us looking at the old
maps and their current maps and which areas were going to be considered part of the
golf course and not. Those changes are fine. We've spoken with them about it before
this, actually. It was just after the reports had gone out.
Nahale-a: Thank you. Does that satisfy your question?

been relocated to its current location next to the new Administration

by Director Gerald Takase on May 17, 2019.

11. Hawaiian Ola Brewing Corporation, dba Ola Brew Co., discussion
on removing conditions placed on its Small Craft Producer Pub liquor
license, Category B1, by the Liquor Commission on April 5, 2018.
Takase: I will give the Commission the background on this. If you remember, for the ones
who were here, but for the new Commissioners, Ola Brewing is a Small Craft Producer
Licensee in the industrial area across the street from My Bar and Club Korea (& Grill). As
part of the original application, they licensed the entire area/property, the building and also
the parking lot to the south side of the property for special events. At the time, the
Commission put a restriction on it (the license), that they would have to notify the
Department whenever they used the outside parking lot area for consumption, and it
exceeded 100 people. They have been, and Brandon can give you a report on their
notifications. We've been sending investigators out each time they had events to monitor
the situation.
Takase: They are coming in now to ask for elimination of that condition. From the
Department's side, we have not had any problems with them. Brandon can give you the
numbers as to the amount of people they have had. It's in the industrial area, there's
nothing else going on in the evening, so parking and noise has not been a problem. From
the Department's standpoint, we would go along with the recommendation. Although our
investigators have been going out, I don't know that there's a need for them to monitor
each event.
Nahale-a: Thank you. Brandon, you have anything to add?
Gonzalez: Good morning, thank you. On April 5, 2018, the Liquor Commission granted
the License but imposed three conditions.
• The first condition was that the number of persons per event outside
shall not exceed 100.
• The second condition is that a temporary permit must be applied for
if more than 100 people are anticipated.

• The third condition was that an annual review shall be conducted by
the Department of Liquor Control.
Gonzalez: As of June 3, 2019, there have been at least seven special events since April of
2018. Those events were as follows:
• April 19, 2018, there was a rehearsal dinner party attended by
approximately 140 people. Liquor investigators went to the
premises and did not observe any violation. They did not receive
any complaints of noise or parking.
• May 31, 2018, for a private party attended by an estimate of
100 people, investigators went to the premises and observed
approximately 40 people, and there were no liquor related issues
or any issues of complaints related to noise or parking.
• June 15, 2018, for a summer brew bash, a music concert,
investigators observed approximately 288 people with no liquor
violations and no noise or parking complaints.
• July 28, 2018, for an album release party, investigators observed
approximately 50 people at the premises with no issues for alcohol .
or parking or noise.
• September 14, 2018, for another release party, cd release party,
investigators observed approximately 500 people in attendance
with no issues regarding parking, noise or alcohol.
• December 15, 2018, for the one year anniversary party of Ola Brew,
investigators observed approximately 500 people, and there were
no issues relating to alcohol, parking or noise observed.
• March 8, 2019, for the International Women's Celebration,
investigators observed approximately 450 people, and did not
observe any issues relating to alcohol, parking or noise.

Breeland: Yes.

Breeland: I am still happy to notify you of any events that we have whether they're under
100, over 100, or over 500. We just want to be able to hold more community events such
as craft fairs during the day, or farmers markets in the outside area where people can also
be consuming alcohol as well. (We would like to hold) more community events to bring
everybody together. Again, I'm happy to touch base with you each time, send you a
notification, but as it stands right now as you know, we have six permits for over 100 people
per year. I'd like to be able to do more than six community events.
Nahale-a: Naeha, would you mind introducing yourself so the Commissioners know who
you are?
Breeland: Yes. I'm Naehalani Breeland, the President of Ola Brew.
Nahale-a: Mahalo. Any questions or discussion from the. Commissioners? Vice Chair
Greenwell, we'll hear your question and take Commissioner Onizuka's question.
Greenwell: Gerald, this could get large. Is there a possibility they need to have a public
hearing? If they had 100 or 140 people, that's fine. But, 288 pushing 300, 500, they want
to do it more often; where are we on notifying the public about it?
Takase: Let me ask you this (to Ms. Breeland). What would you estimate your maximum
capacity is?
Breeland: I would say the maximum is 800. We would never go over 700 though. For our
grand, grand opening on December 15, 2017, we clocked about 750 and everything was
fine. But, we decided that was the max.
Takase: That's the indication from the investigators as well. They could actually put in
more people and it would still be okay. At this point, we haven't asked for a public hearing
because they went through a public hearing and there were no protests to the application.
To date, we've had no protests, or any complaints about the property. We can schedule a
public hearing if that's what the Commission desires. Frankly, I think it's futile. I don't know
that anybody would show up or that there's any concern over this Licensee. I think they've
done a good job of what they've done. They've provided a new venue for the Kona
community and that's the reason they're popular. People want to have events and are
looking for locations to have new activities and they've provided that. It's always within the
Commission's purview to ask for a public hearing, but my official position is as far as the
Department, I don't see the need for one based on the lack of any type of controversy that
they've created so far.
Greenwell: When you have large gatherings like this, do you people hire private security?
Breeland: Yes. For our large events, we have 10 security (personnel) that are there.
We'II have two stationed at entry door, one stationed at the entry to the taproom to make

sure people aren't walking outside into the parking lot, not the side parking lot, but out onto
the street with alcohol. We have eight roaming in the event. Usually when we have music,
we'll have two or three next to the stage and another five roaming throughout. There
definitely is a lot of security. It's to our benefit that we don't have anything go wrong at
those events.
Gonzalez: The Department will report to the Commissioners that the investigators have
observed security and additional personnel at all of the events. Not only do they bring in
additional personnel to monitor the events, they also bring in extra bathroom facilities.
They provide free drinking water stations for coolers throughout the area and also make
sure to have vendors available that offer food. Besides the additional port -a -potties and
free drinking water stations, they also have stations for people to wash their hands if they're
using the outdoor bathroom facilities.
Ibarra: I have a question, Madam Chair.
Nahale-a: We will go to Commissioner Onizuka.
Onizuka: I agree. I think the location you are in isn't going to be causing any problems to
the public, but is this parking lot common area?
Breeland: Common area to other businesses?
Onizuka: For that building, is it a common area?
Breeland: That's just our space.
Onizuka: So, that's included in your lease?
Breeland: Yes. Can I also say one more thing?
Nahale-a: Yes.
Breeland: When we do these larger events like over 250 people, those are not going to be
like, we don't want to do those every month or every weekend. We'd like to do those at
least six times a year. Those would be the six permits that we're using right now. But we'd
also like to do the farmers markets and craft fairs, and I know that since those would be for
longer hours, for instance we'd like to do things from 2:00 P.M. to 9:00 P.M., there would be
a constant flow of people. I know that would be more than 250 people, but it wouldn't be
900 people at one time, or 800 people at one time even. There would probably be a
constant 250 people.
Nahale-a: Thank you. Commissioner lbarra?

Ibarra: It sounds like you have a good operation and everything seems to be great, but my
only concern is legally, and Commissioner Greenwell brought it up, if we're going to bypass;
firstly, is there a requirement for a public hearing under the Rules or Statutes, or does the
Commission have the discretion to bypass a public hearing? I can see, if we're going to do it
for her, the next people that come in following the same process, it sounds like you're going
to get it if you have a public hearing, but I'm just looking at the process.
Masuda: The process is, as a modification you (the Commission) can modify any condition
at any time. Should you increase the condition or decrease the condition at this point; the
question actually is, is the modification a matter of concern to the majority of the public?
That's what you voted on, that's why you have a roll call vote, and you voted that it was not
a matter of widespread concern where the general public would want to weigh in on.
Ibarra: So you said that Commission can do that?
Masuda: The Commission can make the adjustment.
Ibarra: And for future cases, the same can be followed?
Takase: Yes. Typically the Commission grants licenses without any conditions, but in this
case when the license was first approved, conditions were placed on the Licensee because
there was concerns from Commissioners about what was going to happen. It was not in
response to any specific complaints or anything. That is why she's coming in today to ask
for those conditions be removed. I think that since they were Commission -generated
conditions, not in response to any complaints, the Commission is free to amend or remove
those conditions without going to a public hearing.
Ibarra: The Commission could have granted it without conditions at the time the initial
permit (license) was approved?
Takase: Yes.
Salave`a: Gerald, to your point, would you say it's fair to say that the conditions of
approval were placed as sort of a, not temporary, but a trial basis so that the applicant has
a time period in which their performance can be observed so that the Commission could, at
some future time, re -consider?
Takase: Yes. When the Commission imposed the conditions they also asked for us to
report back after one year which we did and it's pretty much the same report that Brandon
just gave you. There was no request to remove the conditions at that point, but this is like
an extension of that. We've passed it and from the Department's side, they have been a
good Licensee. They've done everything they said they were going to do, our investigators
report no problems with them, so this is the next step. They went through the trial period,
they seemed to have satisfied all the requirements, so do they still have to have the

requirements, or can they eliminate them or remove some of them? That's the question
before you today.
Ibarra: Initially, if the permit (license) is granted without conditions, the Commission could
have done that because at that time there was already a public hearing?
Takase: Yes, it came through the normal hearing process like you do for all your other
applicants. There were no complaints or protests against this application at the time it was
originally approved.
Ibarra: So in the future, say you have a similar situation and the Commission denies the
future request from a different business and they argue that a relief was granted from this
one, but actually the Commission already granted the permit (license) with conditions which
it could have granted without conditions because there was already a public hearing?
Takase: Yes.
Gonzalez: I'm going to just interject on the Licensee's history. The license was originally
issued by the Liquor Commission on December 15, 2017. They already went through two
public hearings at that point. On April of 2018, they requested to increase premises to
include the side yard which is part of their lease. That was another public hearing when,
instead of doing a site visit, we had a presentation. From that application, after the license
was already issued and they were in operation for almost half a year, the Commission
imposed the conditions. So there has been at least three fully -noticed public hearings on
this matter.
Masuda: Mr. Gonzalez, that was publicly noticed, but notifications weren't sent out
individually because it was just an increase of licensed area, right?
Gonzalez: Right. The notice to the property owners was already done for the other, it was
still within the previous property.
Masuda: And when the applicant came to increase the license (license premises), it was
already contemplated that there was going to be large numbers. That's why you (the
Commission) placed the restriction of 100 people, right?
Gonzalez: I believe there were concerns about parking and noise because, although it
was in/under their control, it was outside the four walls of the building.
Masuda: So it's all fenced in?
Gonzalez: Right.

Breeland: Of the area? Yes.
Masuda: This is the where you go down the hill, right?
Breeland: Yes, right.

Breeland: Yes, there's one wall on one side and during any large events, we're always
barricading the front of that, right before you go down the hill, so that nothing, no alcohol
can go down the street.
Salave`a: Madam Chair?
Nahale-a: Yes, Commissioner Salave`a.
Salave`a: Gerald, regardless if we have the conditions or when they're removed, if they're
removed, the Department still retains the ability to enforce and manage the Licensee?
Takase: Yes.
Salave`a: And should, not saying that it would happen, but should something occur, it
wouldn't preclude the Department or stop the Department from being able to...
Takase: No, like with all of our Licensees, we monitor them for any complaints and if they
did become a problem, then we always retain the jurisdiction to bring them back in and
either modify it or put the conditions back in place, or even restrict it even further. We have
several opportunities to do that. We can do it as it comes up or we can do it at the renewal
process. It's not like once we give her free reign we can never bring her back.

Nahale-a: Are there any other questions?
Onizuka: Yes, for clarification, this is already licensed, we already granted (it)?
Takase: Yes, on the original license, they sought a license for the whole property.
Onizuka: Including the area that she's using for the outside functions?

Takase: Yes, the whole property. Originally, the consumption was going to be within the
building, but they moved after that to include the parking lot area as part of their
consumption area for bigger events.
Onizuka: On our New Business Item No. 11, it says "discussion on removing conditions,"
and her letter states "potential to make this outdoor space a permanent part of our licensed
premises." It doesn't address removing, her letter is different from what we have on the
agenda.
Takase: In speaking with her about what they wanted to do, that was where she wanted to
get to. She may not have worded it properly, but in our conversations with them, it was
really to try to remove these conditions from the license.
Salave`a: So all we're considering for eleven is removal of the conditions placed upon.
Takase: Correct.
Masuda: How many times do you anticipate having events, I don't mean cycling through,
but en masse, having over 300 people at one time?
Breeland: Right now we think six events per year, so every other month we'd like to have
a show, a music concert.
Masuda: How many times in a year would you anticipate having over 500 people?
Breeland: Usually those big shows are anywhere from 300 to 600. It would depend on
how many tickets we're selling and the artist. We've had Fiji, Kimie Miner, Ekolu, so it just
depends...
Masuda: At what point will you say it's too much?
Breeland: We cut it at 600.
Nahale-a: Mr. Gonzalez, could you read the three conditions that was put on their license?
Gonzalez: Yes. Condition 1: the number of persons per event shall not
exceed 100;
Condition 2: a temporary permit must be applied for if
more than 100 people are anticipated;
Condition 3: an annual review shall be conducted by the
Department of Liquor Control.

Takase: It was talked about like that's what they were aiming for, but I don't believe it was
ever restricted.
Nahale-a: Okay. Vice Chair Greenwell?
Greenwell: Would it be possible, and I'm speaking to everybody, to remove some of the
conditions but put another condition that there be the limitation of 600 people? It seems
to me that an open license for whatever the number might be, might get us in to some
trouble down the road. How many people do you have to have at the party? Maybe we
should issue a limit at the top end.
Takase: The only limit we abide by is occupancy as dictated by the Fire Department.
That's why I asked her what she thought her maximum could be. When she had 800, I
asked how "packed" was it, shoulder to shoulder? She said that it was crowded but it
wasn't a situation where you couldn't move through the crowd (not shoulder to shoulder).
I suspect her maximum capacity is more like 800. It's always the Commission's
prerogative to establish numbers. I don't care to have a number because it's artificial.
We have other licensees that we have no numbers on like Kona Brew, the bowling alley,
the hotels. They all operate somewhat of the same type of environment. There is no
restriction on them. If l limit it to 600, they would have to count, we would have to count,
which a lot of the times it's unnecessary. I think they've (Ola Brew Co.) been a good
Licensee so far. It's not one that I would put a restriction on because we're having
problems with them. We really have no trouble with them. If you put it on her, I'm sure
she'll live with it; but, I don't see the necessity of doing that right now. We can always
revisit this if it becomes a problem. That would be my recommendation.

nowhere, have become quite viable as not only a Licensee, but their business has grown
remarkably well. I would classify them as one of the success stories for business on this
island. They've done a good job at promoting themselves, but also being responsible in
what they do. I've seen a lot of different entities go there to have events, and I think while
it's the newest thing in town, it's also that they do a good job at promoting it and making it
a good business. From our standpoint as a department, we're always supportive of those
types of businesses and we look to those as types that we would like to have in this
community.
